I presume the COA judge would not be on the panel for the appeal. Maybe he could be sitting en banc. |

2. Having said that, Jerry Smith has been one of the biggest COA > SCOTUS Feeders for decades. If you take a group's voice from 25 to 20% or 15 to 25%, it doesn't matter for that group's electoral results. Same if you increase their representation from 60 to 65%.
Where you can get in trouble, however, is when you try to over-optimize your safe seats by giving yourself 55% in a bunch of districts, putting the opponent into a single 95% district. That may be optimal some years, but every now and then an electoral shift comes along, and all of your 55% seats turn into 49ers, and the other side shoots the moon. |
