It ended up getting shut down because some Hawaii judge said that was discriminatory. I wonder if Uber gets away with it because it allows men on its platform. But it will be interesting. My understanding is that the reason that male drivers earn more is because the best time to drive for Uber is when the bars close, and female drivers don't want to let a bunch of drunk randos into their cars. If female drivers suddenly start earning significantly more than their male counterparts once this change goes into effect, the male drivers might have a case.
