I'm tired of these histrionics. The constant ignoring that it's only a temporary restraining order and that many of these lower level judges get overruled and even SCOTUS has stepped in to warn lower courts to behave. And don't get me into the whole shopping around for a sympathetic judge via multiple appeals that makes a mockery of the system in the first place. Or even that tortuous upholding deportation order except to his country of origin which automatically means it's very difficult to actually deport him and leaving him in a permanent legal gray area that he takes advantage of to stay in the US by default. The judge who issued that particular ruling knew exactly what he was doing, a piece of legal trickery.

But Trump's administration is also weirdly incompetent. Seemed like Costa Rica was willing to take him but then they refused to send him there. Do they have a trick up their sleeves? One wants to think they're playing a grand 3-D chess game but as time goes on it's increasing clearer the Trump DOJ is just plain incompetent and unfortunately the D judges and lawyers are much sharper. Trump is losing too much capital trying to get revenge when he should focus on getting even and moving on. Get 80% of your victory and move on.

Maybe the DOJ is gaming for the Tennessee prosecution to reveal him to be a monster and to allow Trump to laugh in the faces of the Democrats who went hysterical over the guy in the first place. But from what I've seen so far, there's a decent chance that will fall apart if a judge rules the prosecution is biased and refuses to let the case proceed.

That's why it's better to take the 80% victory (deport to Costa Rica) and move on.

Based on what grounds? The administration has complied with the courts at every step. He is someone with a standing deportation order. So how is his due process violated to the degree that a settlement is merited?
