And becomes law because the judge doesn't notice. Say for instance a lawyer files a brief with a fake or misdescribed authority and then the opposing party doesn't catch it and the Judge or clerk relies on it. The court issues an opinion adopting the hallucination. Later courts cite that opinion. What's funny about this is noone would even have to cite the AI hallucination they just cite the real judge's opinion.

i wa about to poast how this definitely won't happen and after thinking for a sec i realized it definitely will.

it'll eventually be caught when somebody searches for the underlying authority. which will probably result in a very funny appellate opinion.

Would be hilarious if it got vacated and then someone still decides to cite the vacated hallucination-tainted case. Someone absolutely will try to cite it.

It's 100% going to happen. In my state, the judge usually asks the party that wins the motion to draft the order granting his motion. I highly doubt they check much of anything in the orders that are sent in.

It's interesting bc if the hallucination is just part of the argument and not the whole thing, we'll never know if it was Responsible for the judge's decision. Even the judge probably does not have precise enough access to their epistemic state at the time to say. So even if it's discovered later it probably won't be easy to overturn the original decision. And by then it's exploded to other cases anyway and become a part of Law.

Nobody ever "makes up" cases even with AI

But sample briefs get degraded after being used the umpteenth time like a game of telephone, including case names and citations

The vast majority of real case citations don't even have accurate pin cites or even state the actual proposition of case holding

AI literally makes up cases that dont exist -- infinitely worse than a typical shitlaw brief that's got a misquote or a bad pin cite or even a typo in a cite

i recall asking CGPT about a trade agreement i didn't want to read. it gave an amazingly detailed answer, provided a summary of how it had been used, what the significance was... all based on sections of the agreement that simply did not exist.

No I never assumed it didn't happen, but there is just a big difference, because the barrier to entry for lying is way lower, and so easy to do on accident

It's not substantively any different than an opinion citing a law review article.
