As I recall, there was testimony during Charlie's trial to the effect that Harvey knew nothing about the plot and was very upset when he heard about it. On the other hand, I think the circumstantial evidence against Wendi is very strong. As I recall, there were a bunch of calls between her and Charlie right before the murder happened. On the morning of the murder, she drove past shortporch's house even though it was a major detour on her route. And when she saw crime scene tape at the house, she didn't stop to see if her kids were okay. And there was testimony from one of the hitmen that Charlie insisted that they drive a certain model and color of car, which was the same as Wendi's boyfriend was driving at the time. It's not airtight, but people have been convicted on far weaker evidence than this. My guess is that unless they can find new evidence that can definitely prove that Wendi is involved, they won't arrest Wendi until they either get Donna or Charlie to roll over (or give up on trying). There was a rumor that the DA's office offered Donna a plea deal for time served if she would give up Wendi, but Donna refused. The DA's office denies this, so who knows? A good defense attorney might be able to convince a juror or two that there is a reasonable doubt, but plenty of people have gone to prison on much weaker evidence than this. My expectation is that if the DA's office can't convince Charlie or Donna to roll over on Wendi, they will arrest her and try her on the circumstantial evidence that they have. But they don't want to do that until they have exhausted all other options because you don't get a second chance to try her if new evidence is unearthed later.
