Assuming there is a State-run centralized PD's office.

My State just recently established a State-wide PD's office. Before that, they just had a "List" of attys that took on indigent defendants and they'd be reimbursed by the Gov't.

Now they've created a centralized agency that handles all PD's in the state.

2) A lot of judges are former prosecutors WHO WENT INTO PRIVATE/DEFENSE PRACTICE FOR SEVERAL YEARS TO MAKE REAL MONEY before running for office. You might want to include that in your rant next time.

3) When did I say Pros spent more time talking to shitbag criminals? I said Def attorneys get paid more to deal with shitbag criminals. Hell, in my jurisdiction the PD's make AT LEAST 5k more than the Bros in my office.

4) What "extra" resources are you talking about? Prosecutors don't control Cops. The evidence the cops recover is open to both sides, or did your school not teach Brady?

5) Credibility, well, that depends on jurisdictions. Minority-Majority jurisdictions ain't cakewalks unless you have solid evidence and a sympathetic victim.

I am a former prosecutor. Have never been a defense attorney. In hindsight, when I think about the fact that I had police doing all the investigative work gathering evidence I need to convict, the fact that most people on a jury are instinctively inclined to convict someone of a crime so long as the evidence is there, the fact that when defendants actually invoke their constitutional rights to not testify, juries usually hold that against them despite an instruction not to do so, and the fact that as a general proposition, the odds are stacked in the prosecutor's favor, a defense attorney's job seems more difficult. As a prosecutor, you generally are not fighting an uphill battle. As a defense attorney, you almost always are.

Also this is besides my point. The point is you have an easier job as a prosecutor to do your job than a defense attorney does. Example: Defense attorney's have investigators to, in theory, help investigate. Problem is, most witnesses don't want to talk to the defense attorney or his investigator. Meanwhile, as a prosecutor, you simply just send the cops to do follow-up. Most people who are victims or witnesses to a crime don't really have a problem talking to them.

Nobody likes Prosecutors until THEY are the victim and they want blood/revenge.

Dude, come on. "The burden" is hard, but the odds are highly stacked in a prosecutor's favor. In a lot of jurisdictions, for instance, the prosecutor gets to make the first argument to the jury and the last. That's a tangible strategic advantage. Primacy and recency.

Depends on the jurisdiction. Where I work, juries are not inclined to convict. There's deep-seated distrust of law enforcement. We also have lots of hugely incompetent defense attorneys thanks to the local TTTT. Jurors tend to be sympathetic to the defendants who end up with the really bad ones. As a prosecutor you end up having to both prosecute the case and do most of the defense in order to protect the record. Huge uphill battles, bro.

He got a Continuance on one, but kept the other one in Trial STatus.

So I go up to him during one of the breaks.

Me: So what is the deal with our trial?

Him: Oh, it'll go forward on Wed.

Me: But your expert just left to fly out to New York.

Him: Oh, well, I. . uh. . .hopefully he'll be back by Wed, or else I"ll have to ask for a Continuance.

Me: . . . .?

This FUCKER knew he wasn't going to try my case, but he kept the shit in Trial STatus KILLING my weekend b/c I had to prep for the trial.

So I finally ask the judge (in front of Def and on the record) for determination on what to do since the FUCKER had asked for a Continuance on ANOTHER CASE.

The Judge "instructed" both of us that the two cases would either be tried next month during trial week or they'd be disposed. No more Continuances.

I doubt the FUCKER will try both of them, he only tries cases when the clients cough up the $$$ for trial.

MOST DUI's in my jurisdiction don't go to trial because:

1) The bulk of them are taken by the "DUI King".

2) and he'll only try a case if the number is low and the client pays at least $10k for experts and trial.

The last DUI trial I observed was laughable b/c the Def tried to run the "He's a great guy and here are all of his community/friends to testify to that fact" Defense.

You must be in a small jurisdiction. We have typically have two or three bench DUI trials a day and another two to three go to a jury on appeal every month.
