ABA Considers Accrediting Overseas Law SchoolsPosted by Claire Zillman

An American Bar Association committee has recommended that the ABA consider accrediting law schools outside the United States, according to a story in Am Law Daily sibling publication The National Law Journal.

The committee--composed of law professors, attorneys, judges, and law school deans--distributed its report to state supreme court justices, ABA leaders, and top law school administrators last week, the NLJ reports.

In the report, the panel said that--with state supreme courts and bar associations are under mounting pressure to make decisions about whether to admit foreign lawyers--expanding the ABA's accreditation would "provide additional guidance for state supreme courts when lawyers trained outside the U.S. seek to be allowed to sit for a U.S. bar examination," the NLJ reports.

Broadening the ABA's accreditation overseas would be in line with the globalization of the legal profession, the committee said. The panel cited figures from the National Conference of Bar Examiners that show between 4,000 and 5,000 foreign-trained lawyers sit for the bar each year in the U.S. If the ABA continues to limit its accreditation to the U.S., the committee wrote, states will be inconsistent in how they admit foreign-trained lawyers, according to the NLJ.

One possible downside to accrediting international school, according to the committee: doing so could expand practice opportunities for lawyers trained overseas, while providing no reciprocal benefit for U.S. law school graduates. There could also be political fallout if the ABA failed to accredit a government-sponsored law school, reports the NLJ. The committee said that foreign law schools, not the ABA, should pay for the cost of overseas accreditation.

The committee was appointed in June; the ABA's Council on Legal Education and Admissions to the Bar will consider its recommendations in December

The department of education has given its power up to the ABA to determined accredited law schools.

That means they're arbiter of who gets to take out ultimately bad debt (student loans for TTTs) from the feds.

BFD, there needs to be another signaling group to say that they're truly legit, and let the ABA be relegated to rubber-stamping Universities of Phoenix in Thailand.

the korean bar has like a 2% pass rate. that would be like there being no lawyers in the U.S. who didn't score at least a ~171 on the LSAT. in most places, if you become a lawyer, you're a baller just because you entered the profession. in america, you can go to columbia, get lathamed, and be fucked. lol, we're such scrubs. fuck it..let's just push this to the extreme. that's the only way things are going to change. let anyone who can sign their name on a piece of paper be a lawyer and let the american people see how great it is to have a standardless legal system. after enough malpractice and fuckups, and a few michael moore documentaries, the american people will beg for reform. and then we strike. the easiest way to fix this whole situation would be to get rid of guaranteed federal loans for graduate school. any science phd program worth a damn is free anyway. and promising prospects for other programs will be able to find private lenders.

it's not a matter of spirit and moxie, guy. it's a matter of a war chest.

insurance companies and/or whatever deep pocket you sue will attempt to bankrupt you unless you have an exceedingly cut-and-dried case - that's their litigation strategy.

a simple car crash PI case will probably incur 5k in expenses. do you have that kind of cash to float?

i don't know who is right here. and to be honest i jumped ship. i'd rather live in a box than do this shit. but lawyers just basically want to show up and sit at a desk. they should have done big four accounting or something. that would be more suited to most of them. the fact that they fear shit law ID firms is kinda hilarious though.

TCR, plus for PI you need expert certifications for practically everything. How many of you fuckers have 5k to throw at a doctor? If the depo runs 2 days its fucking 10k. You gotta pay for transcript too and those arent cheap. Those transcriptionists dont make minimum wage. Any decent case takes close to 100k just to get to trial.

Yeah normally they would be trying to protect the wages of their members like most associations. However, most lawyers aren't self employed. I think by inflating supply, they are trying to keep the top of the industry soaking in cash because they don't have to pay their employees as much.

Even if you just cut Cooley, you axe almost 5% of all law school graduates each year. We should be looking to cut 10,000 attorneys a year--that's still 30,000 law students each year, and a lot of attorneys, but can you imagine how much easier it would be with 25% fewer law school graduates?

ABA's legal education plan: create the biggest competition pool amongst students ever to truly (and arbitrarily) separate top students using archaic education models. great for employers, who have their pick at great attorney prospects like a mexican picking strawberries. moreover, ingrain a sense of competition and striverism within each student so they'll illusion themselves with ideals of prestige and "making it" - thus, little to no backlash.

it's the perfect scheme.

You forgot: allow every school that can slap together a law library and a moot court room to open up an accredited law school and use that law school as a cash cow by charging rates based on t14 tuition to anyone with a 150 LSAT.

When student debt levels get so high that they can't take shitwork and still service their debt, import lawyers from China.

I never joined the ABA because it seemed like a fairly large waste of time, essentially a glorified state bar organization, which is basically networking and Kiwanis Club-like celebrity among those who really, truly think it's important. Even though they're basically a rubber stamp for any law school and have abdicated their role in requiring transparency from law schools.

If someone were really, truly serious about trying to compete with the ABA, it wouldn't be very hard to do, if someone were committed. A number of attorneys, generally more conservative, and a number of organizations, like the Federalist Society, really despise a lot of the work of the ABA. They've moved away from a more neutral arbiter acting on behalf of all lawyers to a captured group intent on promoting certain substantive aims of the law (for instance, the unanimous resolution advocating for same-sex marriage last week), or in its judicial rankings (well documented for whatever you can make of it). Which may all be well and good, but it shows that the ABA isn't terribly committed to serving the 1 million JDs out there.

So you'd need to get some of that Federalist Society-backed money and outrage to create a more selective, truly neutral organization that would have more rigorous and exacting credentials, and one that would largely stay out of substantive legal disputes. (Granted, one could debate all day about even procedure, but that's another matter.) It wouldn't take much to place a second layer over the law schools, requesting information, transparency, giving approval (but to a slightly smaller group of the 201 and counting schools). It could make substantive critiques about the objectives in the multi-state bar examination, or weigh in on the seriousnessness of grading. And then, you get a few states, perhaps the most conservative ones, to lead a political charge of swapping out the ABA with this new organization as the arbiter of accreditation, bar exams, and so on.

I don't mean it's not a challenge to do; I just mean, it's not difficult to capture all this outrage, coming from so many different directions (apathy from attorneys who see the ABA as a waste, cronyism of the "network" in the ABA, law students deceived by lack of transparency, a glut of law schools, a lack of legal jobs, sagging wages, a perceived liberal bias), and ball it up into, if someone had the vision, a new organization.

The ABA is basically biglaws love child. All the committees are staffed to the rafters with biglaw partners. "Regular" lawyers have shit say in what goes on there for the most part. Every delegate election you get campaign literature with the return address being some biglaw office. I dont remember ever seeing so much as a single midlaw partner even running for a seat. Its for the elite by the elite. And guess what -- the Federalist Society ass clowns at Harvard and the like practically all join the ABA at graduation because their firms pay for it (though the first year or two of membership is actually free). Im only a member because my firm pays for everyones membership. Firms like mine are the only reason they have any paying members at all IMHO. How many lawyers pay out of pocket for their bar association memberships? If your boss isnt covering it chances are you dont belong to any association at all.
