It's hilarious how they fawn over this firm like it's some magical unicorn. They have no idea that there are vastly more similarities than differences in the day-to-day of biglaw litigation and boutique litigation. They also fail to realize that the compensation offered by lit boutiques to associates and partners is not consistently higher than that offered at a V10. Sure, for some absolute superstars or people who get really lucky, it can be, but on balance the good years may not outweigh the bad years enough to make a meaningful difference.

Don't get me wrong, at a place like Susman or W&C associates definitely have a much higher chance of doing depositions or participating in trial earlier in their careers. But that also depends on luck (especially participating in trial). The bulk of the work is still plain old legal research and writing and random tasks associated with managing a case. TLS fuckheads are kidding themselves if they think there's going to be a world of difference every day, that they could only be happy at a boutique. It's a bunch of striverish neurotic nonsense.

Right, it's like litigation at X firm magically involves fewer motions, requires less legal research, and is more likely to go to a jury trial. It's like litigation changes depending on the firm. It doesn't. Certainly, your experience can vary widely depending on your staffing and your firm, but it's not like litigation turns into 20 deps and 0 evidentiary motions when you step into a boutique.

I never found discovery "hellish." Discovery is how you find the facts of the case. Discovery is how you find the documents that you'll use in your MSJ and introduce at trial. Discovery is how you figure out what the witnesses are going to say.

If you're in smaller cases, you have less discovery. But you'll probably have a smaller staff working on the case.

The hellish part is never discovery. That's time-consuming, but it's not necessarily timed, and you get to pace yourself. The hellish part is the trial, when you're billing 400 a month. Yeah, there's adrenaline that gets you through it, and the thrill of trial.

So it all depends on your definition of "hellish." But if the thought of perusing documents to obtain facts for trial bothers you, you probably shouldn't be a litigator in the first place.

Yeah, sometimes, you're on a giant case with a ton of discovery and you're solely called in for doc review. But that's the qualification above. Some litigation cases are dogs and you're just an extra cog filling in some billables; some cases you're an integral part of the team. At a boutique, maybe you're more likely to be an integral part, or maybe you have smaller discovery. But it's not so radically different that you can suddenly create chasms between firms.

And there's a chance you could do more doc review than at a biglaw firm depending on what cases you're on and what biglaw firm we're talking about. Look, there are differences, but they are not so substantial as to suddenly make the litigation job a fun filled life in the courtroom. They are much more similar than different.

Many associates at big firms get staffed on HUGE cases like securities fraud that gets past a motion to dismiss or consumer fraud or products liability. Most boutiques are not set up to do this type of massive litigation.

Massive cases are bad for associates.
