BarBri Essay Grades - Disheartened

Date: February 5th, 2012 1:05 PM Author: honey-headed twinkling uncleanness When I did BarBri, I turned in essays for grading at every opportunity, and after seeing each grade was convinced I was going to fail the bar. After the bar, one of my essays was published by NY as a model answer.
Keep in mind that (a) BarBri is in the business of convincing you will fail unless you buy all of their extras and (b) the people grading for BarBri probably barely passed the bar themselves. It's not like BarBri has the best legal writers in the world; rather, they likely hire people who have washed out of law. |

Read the past threads, people have mentioned things like BarBri graders writing shit like, "You should discuss use of evidence for impeachment" despite the presence of a all-caps heading saying "POTENTIAL USE OF EVIDENCE FOR PURPOSES OF IMPEACHMENT". It's pretty fucked.
I won't say don't turn them in, because it *might* help, but the act of writing them out is the most helpful part of the exercise, which is itself of questionable utility. I'd personally focus my energy on reading essay answers above all else. |

Reading the CMR is not what you need to be doing. Reading essay answers is what you need to be doing. If you're writing these at all like law school essays, you will fail. You need to follow the particular form the bar examiners want. Be basic, cover every introductory step, even if you think it's stupid. Here's an example for the question of, "Is this piece evidence admissible?"
BAD: "The evidence is admissible because blah blah blah."
GOOD: "The issue is whether [the particular piece of evidence] is admissible [in the particular context]. In New York, the rule is that such evidence is generally admissible for X purposes. It can also be used for Y [totally unrelated purposes]. Here, the party is seeking to introduce the evidence for [whatever purpose]. It can be admitted because [put in your analysis]."
Just throw as much information out there as possible. Make it easy for them to give you points. That essay, EXACTLY as I wrote it, would probably be worth at least a couple points, and maybe a couple more if I actually bothered to make up some law instead of just writing X and Y. |

New York isn't graded holistically, they have a big chart about what they'll give you points on. Don't try to wow them with your high-level analysis.
