This was back in the mid-90s. Then-18yo girl was at a diner using a payphone at midnight, and a man in a van says he's lost and needs directions to a local business. girl agrees to drive him to the business in separate cars with the man following behind. they're driving there, and man pulls over on the road. she gets out of car to see what's going on and approaches his van. the man pulls her into the van, ties her up, and rapes and sodomizes her.
she reports the rape and swabs are collected. police can't ID the perp, and case goes cold.
many many years later, police start using familial dna to try to crack cold cases. police discover a match between the dna from rape kit and a dead woman whose dna is in a public dna database.
police look into the woman's relatives for potential suspects in the rape, and suspect that the dead woman's son is the perp. police then go to the son's house, find a soda can from his trash can, and test if for DNA. DNA matches the rape kit.
police then arrest and charge the perp. he was in his 40's at the time and is now in his 60's. man had somewhat of a record in his youth, but has led a relatively crime-free life since the rape.
my question for xo: should he be convicted of the rape? should he be locked up for life?

what's the counter arguments here? that if someone escapes justice for long enough and doesn't get caught commiting more crimes they get a pass?
the fact he escaped justice for this long it's points against him, not for. he should have been in jail during the prime of us life.

No. Police should be prohibited from using "familial DNA" to track down and charge suspects decades later, and their ability to offer DNA evidence generally should be restricted to extremely narrow circumstances.
It should be a felony for any individual or corporation to maintain a "public DNA database" that includes U.S. citizens in its dataset.

a lot of people post their DNA on a site like Gedmatch. i think Gedmatch now prohibits cops from looking at DNA unless the DNA donor opts in. anyway, the cops upload a DNA result from the perp to a site like Gedmatch and, for example, may see a significant match with some woman who is probably a first cousin once removed or a second cousin of the perp.
if the cops can ID the woman they then build out her family tree of all her close relatives. they start eliminating men who were too old or too young to be the perp or who lived far away from the crime.
at that point they may have 1 or 3 or 10 good prospects. cops stake out the trash of the suspect men and look for soda cans or other trash that may have saliva. they test that DNA against the perp's. they may have a perfect match in which case they found the perp.

They don't match THE ENTIRE 46 chromosomes

what do you mean they don't match all 46 chromosomes. I'm a litigator, but not a criminal one.
They don't match them all for family DNA matches, but the story said they got a full hit on the perp's DNA versus the rape kit.
He should get 15-20 years unless there's a reason to doubt that this was rape rape. But given the story and that she had a rape kit processed and had no idea who the dude was before, that seems unlikely.
