Date: May 16th, 2024 4:34 PM Author: fragrant unholy stag film sneaky criminal all privileges are pretty dicey and filled with a bunch of exceptions and balancing tests. but it's best to think of them as a shield rather than a sword. a judge is far less likely to compel testimony when a privilege is claimed versus excluding testimony from a willing witness.
ACP is one of the least tested privileges because attorneys don't frequently testify against a client who is asserting the communication was privileged. we've got a unique situation here where cohen taped trump without his knowledge and cohen has already testified against trump in his individual case. a judge is going to be hard pressed to exclude this testimony since it's already a matter of public record.
you also have the super consideration that trump is very bad orange man and indictments that would be dismissed ordinarily are allowed to proceed. so a judge allowing privileged testimony that would ordinarily be excluded is no surprise at all here. |
