Note how the way people respond to affirmative action seems to be shaped by the framing of the polling question. I.e, AA is popular when it is used to help minorities "get better jobs and education," but it's less popular when it gives "special preferences" (not sure how you can do the former w/o doing the latter). And note that there may be some people who evidently think that AA is a "good" thing, but at the same time it is also "unfair."
You could argue that the hair splitting in Grutter ("factors" = okay, "quota" = nope) just reflects wishy-washy public opinion. Not the most original idea, obviously. |
