In Grutter the court decided 5-4 to allow affirmative action to continue. The 4 justices who voted against AA in grutter are still on the court, but 3 of the liberals are not. Now that Sandra has been replaced by Alito it seems clear that affirmative action would be banned or strictly curtailed if the court hears an AA case. Employers need a cover from racial discrimination suits, and need to hire x number of blacks anyway and will always hire unqualified blacks, AA or no AA.
Also, ending AA would be a move toward the meritocratic ideal but it's not just blacks who oppose meritocracy; the upper-classes prefer to reserve the highest-rung positions in government, finance, media etc. for their scions. The U.S. will never adopt a purely meritocratic educational system like the one in Germany, Finland, Japan, China or Korea for that reason.

Race-based discrimination is no longer a significant damper on black achievement. Quite the contrary, blacks in recent times have been given superior opportunities to whites. While the black-white achievement gap continues to grow, the causal relationship between that gap and discrimination, if any, is so attenuated now that it serves only as an excuse, not an explanation. Thus, I see no merit in race-based AA for remedial purposes.
The question, then, is whether race-based AA has any other type of merit. The most compelling argument for race-based AA, as far as I can see, is that it may be a small price to pay for reducing forthcoming racial unrest. I doubt that AA will actually reduce racial unrest, however. The majority of blacks are in huge trouble with or without AA. AA gives the cream of the crop a tremendous career boost, but does nothing for the black masses. Today's economy requires skills that they don't have. AA won't teach them how to read and write, much less how to program computers. |

We ban racial discrimination in our constitution because we have decided that allowing it violates the rights of our citizens. We shouldn't throw those rights away because some citizens are angry about losing their special privileges. After all, allowing blacks to have good jobs angers the KKK and other white nationalists. Should we force all blacks to be janitors or something? Of course not.
