i've never seen it, and haven't seen the argument in the time I paid attention to pedagogy
sorry I didn't attend a TTT blind grading UG where this shit was debated
if what you say is true, it is not novel, but compelling nonetheless

Um... no I went to HYPSM for UG, however, I heard this same argument when I was about 16...
It was a cover for AA admits and kissups then too
If this is compelling to you, thank you populism for allowing mentally disabled people like you to vote.

"We have all had the student that we think is bound for great things do poorly on our exam and the deadbeat student get a B+ (or even an A-)."
Exactly why blind grading is necessary. Profs assumptions are wrong and the "deadbeat" is actually a legal all-star while the kid "destined for great things" is just a loud mouth.
I have a sneaky suspicion that many of profs think I'm a deadbeat yet I have 6 A's and 2 B's. It must drive them nuts.

Newsflash
Someone who preps for class and does great in class but then bombs the test is a FAILURE.
Someone who studies last minute and gets an A- or A is a WINNER.
This is b/c the only thing that counts is performance on the test. The people that prep solely for the test are the smart ones, b/c that is the only thing that matters. While, it is great that some one put in time prepping for class, this is not what matters. The test is and students that prep for class and not the test are being stupid. Sure they might "deserve" a higher grade b/c they worked harder but life doesn't care what people deserve, it cares who does the better job (in theory at least). This is similar to rewarding an attorney for a beautifully written motion and their pretrial work instead of rewarding the attorney for whether or not they win.
The professors are essentially saying they want to reward the stupid (ie: those that don't focus on the test) b/c they feel the stupid are more deserving.
Also, it is clear the professor hates the fact that someone can slack in his class and get an A. If you hate that someone doesn't need to do any work, change your fucking test or make your class harder. Don't punish the person who is working smarter (ie: not doing busy work during the semester when it has no pay off). Not everyone is so fucking in love with your topic area as you are. Some(most) people just aren't in as much love with torts as you are. Just b/c students don't give a shit about the subject, is not a personal insult to you.

i pulled A's in several 1L class that i never attended, like seriously, maybe 20% tops. i didn't get anything useful out of the lectures, so i didn't go, but i studied the bll and the committee notes in depth all term.
whenever i get coldcalled, i sound like a total shithead because i can never remember which case is which. that's because my outline is thematic and procedural rather than organized by case. outside of a few classes (con law, fed courts) who the fuck even reads cases? you need to know about six to ace civ pro. the only property case i can ever remember is the one about the goddamned fox.
i don't think there should be a prize for showing up the most. i think there should be a prize for knowing how to apply the frcp, ucc, fre, and mpc to facts better than the dude who sits in the front row and never shuts up.
i'm glad that, if blind grading goes, it'll be after i'm gone.

"Professor Benforado's scholarship involves applying the insights of social psychology and related fields to law and legal theory. In large part, his work is focused on uncovering how our legal system may reflect unappreciated aspects of our cognitive frameworks and processes, and, as a consequence, how the law may fail to align with our purported values and fail to meet our needs. He is particularly interested in how corporations and other powerful entities exploit psychological proclivities to advance their agendas directly and through the legal system." http://www.drexel.edu/law/faculty/adam-benforado.asp

No, this would lead to protests, like when students at Harvard protested over there being no black women professors.
Derek Bell used to ask "Are you telling me NO black women are qualified to teach here?"
The answer was YES!
The same question will be asked about why no blacks get an A.

He wants to be able to judge a student's background and experience- why, because that summer mommy and daddy paid for you to do volunteer work in China or backpack around South America has any relevance to a 1L torts class? Fuck.
The "deadbeat" students are doing exactly what smart people do, they look at a problem (how to get good grades 1L year of law school), and figure out the most efficient way to solve that problem without actually cheating. And if that rubs professors the wrong way, they should change the system to benefit the gunners who spend 12 hours in the library rereading the cases but don't do an hour of research on how to take a law school exam.

Did it "work" in UG? Or were the adverse effects simply too small to bother implementing blind grading systems, which carry substantial overhead?
UG grades frequently aren't curved (i.e., they are non-zero sum) and generally don't matter as much as LS grades. And most students don't take on the sort of staggering debt that is associated with LS in UG; there's just far less riding on whether any given professor feels the need to bump "deserving" students up in courses where grading is quite subjective.
Moreover, blind grading is not just a device to assuage the concerns of 1L's. It clearly has an effect: it prevents idiot professors (such as the subject of this thread) from downgrading "deadbeats" who perform well when it counts and upgrading those "bound for great things" who are unable to perform under pressure. We're not talking about a formality. People like this professor would actively meddle with the process if they were so permitted.

Flame?
Robust blind grading systems require independent third parties to issue students unique exam ID's for each exam; then professors submit a set of grades for the ID's plus a set of student identified bumps for any discretionary element. The third party then has to properly correlate the grades and students. Notice that in UG there are frequently midterms (sometimes more than one), which means that the professors wouldn't just be reporting to the third party one final grade--they would have to use this blind grading system with unique ID's for every test. If you can't appreciate the overhead this entails, I don't what to tell you.
In LS your fate is largely decided in two semesters. The grading is curved, and the competition is fierce. In UG, classes are frequently not curved and most employers don't make hiring decisions on the basis of fine GPA distinctions--and to the degree that they do, it is generally based on 6-8 semesters of information, making any one class far less important. Moreover, a large percentage of UG majors have exams that are inherently objective (most of the non-humanities majors). Again, if you can't see the huge gulf between UG grades and LS grades, I don't know what to tell you.

you're fucking retarded. the things you identify don't require substantial additional overhead. a different way of doing things =/= "additional overhead." this mysterious "third party" you're referring to is just another student worker or two who get paid $9 or so an hour to work in one of the school's administrative offices. (i've been assuming you understand what "overhead" means, but i'm starting to doubt that. i work in finance so yes, i actually do know what it means and i cringe when people use it retardedly.)
and i already addressed your second point. as i said above, ls grades may indeed be more important than ug grades, but there is absolutely no "huge gulf" between the two. you're confusing *how important UG grades are vis-a-vis ls grades* with *how important a given UG course is vis-a-vis a given law school course.* not the same thing genius.

Jesus christ you are dumb.
1. "A different way of doing things" that requires an additional 100 hours of work per semester -> overhead. Also, a $9/hr monkey will probably fuck up 5% of the grades.
2. I'm not confusing the two. Both the lower number of grades (which means it's far more likely that a single professor will screw you over) and the greater emphasis ER's place on grades favor a blind grading system.
You are a horrible poster.

hey can you do me a favor and completely remove the word "overhead" from your vocabulary? no seriously, can you? and think about what your argument has become: "well, uh, student workers, uh, will fuck up blind grading so, uh, well, we have to use highly paid geniuses to do the monkey work that is blind grading administration, which is why teh blind grading adds a lot of teh overhead!!!!!!!!!!!!"
go ahead and respond with "you're a bad poster." that's literally the only thing you've got going for you in this debate.

"We have all had the student that we think is bound for great things do poorly on our exam and the deadbeat student get a B+ (or even an A-). That hurts given that potential employers (law firms, judges, and others) use grades as a primary screening tool when deciding between candidates."
Or maybe you were WRONG about who was smart/hardworking and who was trying to appear smart/hardworking. I guess that thought didn't enter your mind. Learning is done at home not in class while wasting everyone's time with inane commentary or sucking up to you in office hours you WASTE OF SPACE. Get a real fucking job.
