RE: Obama's Taxation of White People Who Want Tans

I. STATEMENT OF FACTS
Obama's socialist health care bill includes a tax increase on artificial tans. At least two of Obama advisors, Treasury Secretary Tim Geitner (a.k.a. "Tax Cheat Timmy") and former South Dakota Senator Tom Dasshole, have cheated on their taxes. Obama has previously called his own grandmother a typical white person.
II. QUESTION PRESENTED
Is taxing artificial tans the least racially discriminatory way to raise taxes where the President of the United States employs advisors who have cheated on their taxes?
III. ANALYSIS
A. Is There a Classification?
The first issue is whether Obama's health care bill has a racial classification.
A racial classification exists if there is a discriminatory impact and purpose.
Here, taxing tans has a disparate impact on whites. Recent studies show that 99.999% of people who get fake tans are white.
Moreover, taxing tans has a discriminatory purpose. There is no question that Obama harbors a deep animus towards whites - witness his comment that his grandmother was a "typical white person."
In sum, Obama's health care bill contains an invidious racial classification.
B. What Is the Appropriate Level of Scrutiny?
The second issue is what the appropriate level of scrutiny is.
A law that contains a racial classification is subject to strict scrutiny - i.e., the law must be necessary to achieve a compelling government interest.
Here, there is a less discriminatory means of generating tax revenue than taxing tans. For example, Obama could demand that Tim Geithner and Tom Daschle pay their taxes. Thus, the health care bill fails strict scrutiny.
IV. CONCLUSION
For the foregoing reasons, the health care bill is racist and unconstitutional.
