BTW I'm at a T30, top quarter of my class, LR. Chances at getting a non-prestigious district court clerkship / clerking for a magistrate / clerking for a bankruptcy judge? Have any estimate?

I'm at one of the more competitive districts (CD Cal, SDNY). You could get a clerkship with a magistrate if you were from a local T30 school. Probably out of the running for a district judge.

Thanks man. Know anything about bankruptcy judges?

I kind of figured it was too late for me to get a D. Ct. clerkship anyways--I hadn't even planned on applying until my firm no-offered. I'll try to focus on the less-prestigious district courts in this area and magistrate judges.

I'm thinking if I can somehow land a Magistrate clerkship, maybe I can actually get my ducks in a row earlier next year and start applying for D. Ct. clerkships in the Spring of '12. Gotta claw my way up the ladder somehow.

What do you think my odds are in applying to Magistrate judges in TTT cities out of my region (e.g., Las Cruces NM) where there isn't a tier 1 (or even tier 2) law school nearby?

I guess you could have a shot if there are no law schools nearby. It's different for my court, because we have good law schools and TTTs in our district. I know all the clerks for the magistrates in my court, and most of them are top students from the local TTTs. Some Harvard/Stanford clerks also, but I get the sense that they had crappy grades. No idea how magistrates hire if there aren't nearby law schools.

I don't know anyone who went from a magistrate clerkship to a D Ct. clerkship. I'm sure it happens, but that's not as common as going from D Ct. to COA.

magistrate judges are often brilliant lawyers with stellar reputations and connections in the legal community. a lot of law students miss this point. they likely know as many law professors as district judges. and they are also swamped with applications.

A lot of people forget to include the correct name of the court in their cover letter. They apparently can't use auto-replace correctly. That is an auto-ding. And putting bizarre things in the hobby section - don't do it. List something simple and normal, like running or hiking, not Star Trek, bar-hopping, etc.

So you are saying you have to add the name of the court to the address, and if you dont that is an auto ding?

If this is the case, it just underscores why this process is retarded and it's best to apply off plan.

No, that's not necessary. But if you do include the name of the court, include the correct one. This is particularly true when they include the court name in the body of the letter. For example, one letter stated, "I am very interested in clerking for the United States District Court for the District of Maryland." That is not my court.

We don't read the writing sample until they get an interview. Just not enough time to read every writing sample. At least for my judge, the writing sample doesn't matter very much. Just don't have typos. This probably is not true for appellate courts. I am clerking on a COA next year, and all of my COA interviewers asked me about my writing sample.

SO if I get an interview, can I fed ex a revised version of the writing sample? I spotted a typo and I didn't correct it until some of the apps were already sent.

When you write an order or an opinion for a judge, you can't retract it the next day because you just spotted a typo.

If you're applying for D Ct. clerkships, there's a good chance that they won't spot the typo, particularly if it's buried in the middle. How bad is it?

Its buried in the middle but I mean...its clearly a mistake.

Why does it differ between appellate and district courts?

I understand why typos are bad. I am not defending them...i dont know how i missed it.

not worth trying to fix it now. We've interviewed a few candidates so far, and I don't think any of us made it to the middle of their writing samples.

appellate courts are much more focused on writing. district court clerkships are more about responding to daily crises.

Especially because clerks don't work on holiday weekends, and most leave early for such weekends. The courthouse was freakin' empty on Friday afternoon.

We're government employees, after all.

I lucked into a District Court interview (median at t25, scored interview thru good references)

Is this still going to be a "fit" interview or should I expect questions about my qualifications? What should I do to prepare aside form reading recent opinion?

Congrats. Especially in this economy, getting a d ct. interview with your stats is a big accomplishment.

The interview still will be mostly about fit at this point. The only thing that could really hurt you is if a clerk tells the judge that your grades suck (most judges don't have a very good idea about grades and class rank, so they rely on clerks).

See if your school keeps a feedback book from other students who have interviewed with judges. This can be very helpful - they tell you what sorts of things judges ask about. Some interviews are very informal and you just talk about your background, hobbies, etc. Others are very substantive and they will quiz you about specific topics. Best to know what you're walking into. Also make sure you know every line of your resume and the obvious questions (why did you take that job, what did you learn from it, why did you leave). Easy stuff, but we had a clerkship candidate who didn't seem to know his own resume.

Do you mean you scored the interview because your LORs were excellent, or because one of the judge's friends called on your behalf? If it's later, the judge may be interviewing you as more of a courtesy to his friend than because he really wants to hire you. However, I know my judge once hired someone from this kind of interview, because that candidate presented extremely well in person.

The latter. Fortunately I do present well in person- i spent two summer in Biglaw and rocked an improbable 85% screening interview to callback and 90% callback to offer ratio with these grades.

So I finished up my writing sample and basic cover letter today. Hopefully will have my LOR's in by early this week. I have my list of judges ready--mostly District Courts in regions where my school has pull and Magistrates in TTT districts all over the place.

Edit--Also, I was no offered by my summer firm for "economic reasons." I'm getting at least one LOR from a partner at the firm, possibly the hiring partner, and I've been told repeatedly that my no-offer wasn't performance-related (in fact, my whole class got no-offered. . . I know).

How fucked?

You need to get those all in overnight mail this week. Hiring plan, man. A few judges will hire after the hiring plan rush, but not that many. Even if you don't have all your LOR's, send those things out now!

Just make sure that your cover letter and resume looks like a finished product. You don't want the judge (and clerks) to look at the app and think, "this is the last-minute application from someone who was no-offered."

If you were cold-offered rather than no-offered, your chances are much better.

Nah, I'll make sure it looks nice. Hell, they won't even know that I was no-offered until I get an interview, right?

I don't know how to handle this no-offer shit. Won't a LOR from a higher-up at the firm + the fact that my whole class got the axe do anything for me? I mean, there are quite a few of us no-offerees running around out here. You'd think that after the great debacle of 2009, the stigma would be gone.

That's the story they've been pumping on ATL, but I know more people who are either waiting to hear back or have been no-offered than people who have received offers.

Granted, not a ton of people at my school got summer gigs at Vault firms to begin with.

So should I be all like "I didn't receive an offer, and the two other guys in my class didn't either. We were told that it was for financial/economic reasons, and that if the market started to improve they would possibly reconsider." ? (this is true) Is that the best way to spin it?

I don't even feel like I should HAVE to spin this bullshit, since it was my firm's fault, not mine.

if you're asked, that's the best way to spin it. as long as you tell the truth - because the judge may want to speak with a partner at the firm.

Well, that's the truth as I understand it. I just talked to the other two guys on Thursday, and both got the same speech that I got, and neither got offers. The weird thing is that the firm left it sort of open-ended with all of us. I guess I'm not ruling out the possibility that the firm could go back and make an offer to one of the other guys (especially the guy who was an URM--the firm was lily-white). I don't think that would happen within the next three weeks or so, though.

I'll just say that none of us got offers, and we were told that it was for financial reasons.

Are you planning to take it this year? As long as it's on your transcript, it's fine. No need to have taken it as a 2L. But you should take it this year. It has been very useful so far.

And yes, Magistrates will care just as much as d ct. judges. There is this weird myth that magistrates will take any random hobo who applies for a clerkship. Their standards are much higher than the xoxo wisdom.

Nah, it's not being offered this semester. Can I just tell them that if I get a clerkship, I'll make sure to take it in the spring?

Also, I'm not trying to discount magistrates' standards or anything. I just know there is relatively less competition for those spots.
