I read that one as simply being: did he have the actus reus and mens rea to commit the crime. Also threw in the definition of possession in there. That's why the DUI one threw me off, because it seemed like 2 questions were simply asking about the elements of a crime and whether they were satisfied.

issue is whether bank is holder in due course and thus takes the check free of personal defenses (fraud in the inducement).

Regarding criminal possession of check. i thought the issue was whether the checks are forged instrument. Forgery has a specific meaning. The instrument itself has to be false, not just the content within the instrument.

The bar doesnt expect you to know much about NF. Insurance law in general is too hyper technical for them to expect much. All they want you to know is the very basics you would need to know should a car accident case walk through your door. The barbri NF outline is only a couple pages long if I remember right. Nobody is going to put a Mallela question on the bar.

CC and ST only require route memorization of a few black letter rules too. Its laziness to go into the bar and to just discount that shit. You have no one to blame but yourself if you fucked up.

Thoughts:

Property Q was really fucking straight forward. If you knew the rules, you were guaranteed at least a 7-8 I think

Crim Pro part of the Q wasnt bad. I think I laid everything out right. Illegal search right? Not enough for terry frisk to search envelope and it couldnt qualify for SITA? Also I thought he couldnt be convicted b/c they never did anything with the intent to defraud aspect of crime. Might be wrong on that though. Completely made up shit for the commercial paper part of the Q.

Domestic Relations was straight forward. Was expecting much worse based on Barbri sample essays. Was just estoppel and change of circumstances, right? Corp. was simple duty of loyalty. And secured was just breach of peace.

Torts/BAC was some weird shit.

Wills was straight forward. Both wills denied probate. And he breached fiduciary duty with no diversified portfolio. And no personal liability for non malpracticing partner in LLP.

MPT was easy as fuck

Might be wrong, but I think fairness is a defense for self-dealing--that works in DE, and I seem to recall it working in NY. Avoidance is the usual remedy, absent showing of fairness or curative approval.

it's been a relatively unimportant topic over the last decade or so. i think it's come up 7 out of the last 10 years and 6 of those 7 times it was only on there as a 1/2 or 1/3 of a tort question so you can say "battery has a 1 year SOL in NY".

just like barbi's chart says secured transaction and commercial paper never show up, yet the NY bar has given an essay on those every single year for like 10 years now (alternating between the two and this year both showed up)
