Jones Day Sex Bias Suit’s Jane Doe 4 Dropped as Named Plaintiff

A female associate who sought to participate anonymously in a proposed sex bias class action against the law firm Jones Day has been dropped as a named plaintiff in a new court filing.

Nilab Rahyar Tolton, Andrea Mazingo, Meredith Williams, Saira Draper, Jaclyn Stahl, and Katrina Henderson filed the second amended complaint with the U.S. District Court for the District of Columbia Aug. 12. They are six of the seven women who brought the $200 million suit against Jones Day in April, claiming sex discrimination in pay, promotions, and based on pregnancy.

Jane Doe 4 was the seventh but she is no longer mentioned in the new filing, which came in response to Judge Randolph D. Moss’s Aug. 7 denial of her renewed motion to proceed under a pseudonym rather than her real name. The judge rejected Jane Doe 4’s argument that keeping her identity secret wouldn’t undercut the public interest in open court proceedings and was necessary to protect her from potential harm to her professional reputation and career opportunities that might ensue if her name is released.

Williams, Draper, and Stahl initially sought to pursue the case as Jane Does as well, but they added their real names to a first amended complaint June 24. That came after Moss on May 30 ruled that Jones Day could disclose their identities during its investigation of their allegations and while preparing its initial response to the lawsuit.

The six women who remain as named plaintiffs accuse Jones Day of systematically denying them and other female associates equal pay and career opportunities through the use of a “black box” compensation system and other employment practices controlled by the international law firm’s managing partner, Stephen J. Brogan.

Women lawyers also face sexual harassment and are retaliated against when they become pregnant, the suit alleges.

Sanford Heisler Sharp LP is representing the proposed class. Jones Day is representing itself.

The case is Tolton v. Jones Day, D.D.C., No. 1:19-cv-00945, second amended class complaint filed 8/12/19.
