In this case, there's no argument that not dismissing would protect the defendant's rights, therefore the court has no possible alternative but to dismiss. Am I correct that all the other cases in which a judge examines a motion to dismiss charges, the purpose of the examination was to make sure the dismissal was not infringing on the defendant's rights?
Edit: She kept saying there was no case or controversy, but she didn't explain exactly why there was no case or controversy given the court's power to decide whether or not to grant a motion to dismiss. Surely she could have explained why, such as the fact that the discretion is *only* to protect a defendant. |
