bannon skipped out on the subpoena because he asserted executive privilege. seems like a strategic legal move. plus the contempt charges are misdemeanors, and although they technically could result in jail time, realistically worse case scenario is he pays a small fine. whether you agree with his strategy or not, it doesn't seem like his decisions were out of stupidity.

i've never heard of anything like this happening before. there's always going to be back room chatter regarding an appointees merits and intelligence. i don't recall anyone from the right cautioning reagan not to appoint thomas because he's too dumb. |

EDIT: I read the letter, and no where does it say that Sotomayer is dumb. At most it says, in the context of her "being a bully" that she is "not as smart as she thinks she is" and the main focus of the letter is what to do with Kennedy. Kind of disappointed Gunnerrat you've been providing decent analysis on here recently but you missed out on objectivity on this one. |

the media i consume has been forcememeing that thomas is an idiot because he doesn't ask questions during oral argument since i was in college.
i don't think soto is dumb because she's the most liberal member of the court, i think she is dumb because i've heard her speak and read her work. (also, to be clear, i don't think she's "dumb", just that she's far and away the dumbest member of the court). it has nothing to do with her beliefs. rbg was more lib than her and i respect her intelligence. kagan might be one of the smartest members on the court and she is lib. |

But I think what we were talking about is whether Bannon is in a position to criticize her intellect--meaning is he smarter than her--and I dont think thats the case. |
