Working on a real estate deal. Building sits on land owned by a railroad company, building owner pays yearly rent to the railroad.

It seems crazy to buy the building and hope the railroad just keeps renting the land to me. It's on a freaking one year lease. So I would propose to the railroad that I buy the land, or at least rent it for a very long period. Dollar amount of the lease is trivial, maybe a couple thousand dollars a year.

Has anyone ever dealt with this before? I've heard doing anything with a railroad is super bureaucratic.

Just consider yourself lucky that whoever owns that railroad doesn’t own all four railroads.

Good luck, brother. Railroads aren’t in the business of selling land from what I gather. Maybe they’ll make an exception for you.

Merely asking the railroad to do this could cause them to decide not to renew the lease or ask for a crazy higher amount for rent.

Railroad’s don’t like to sell property and they have very aggressive lawyers who are part of an old money clique that’s very hard to break into.

I’d recommend leaving this one alone.

A building sitting on year to year leased land is unsellable (except to you or your client apparently) and unleverageable. If the current owner wants to sell the building he ought to help you with the negotiation with the RR. You should only want to buy it contingent on satisfactory ground lease terms from the RR. Is it Short Line by any chance? What are the politics or special relationships in this situation?
