I got a 106 and I ran out of time for the last 14 questions and didnt bubble them in.
The one question that pissed me off was the leaf blower conversion question. In his lecture the torts guy said you "get a new" car but their model answer said you get the market value of the leaf blower in the condition it was in prior to the conversion not the the cost of a totally new leaf blower.
I would say like 20% of my mistakes are the result of not reading the question properly.

Plus, think about how you would grade all those books. Wouldn't make sense to take a first cut at it with the MBE scores? At least sort them into stacks of quartiles or something. If a guy got a 170-180 / 200, how hard are you going to look at his essays and PT?

The answer to your question is that it varies from 10-20 points year-to-year. If the necessary score is indeed 133, then you are guaranteed to pass with a 123 (raw) to waive into DC. As far as I can tell, this means 123/200 (I think the ten-point bump is to account for the 10 experimental questions). But the scale varies from a 10-20 point bump depending on the year. This is what I understand from BarBri and friends of mine who have taken the exam, however, I could be wrong...

Another thing, are you skimming the fact pattern, looking for the main points, OR are you reading the fact patterns very closely?

nah, i can bust my process out in 3 or 4 hours, as opposed to 12 hours through barbri. a lot of my friends that already attended said it was a complete waste of time. at best, i would get 2 or 3 points of useful.
i think it depends about how you feel- if you think you knew the rule and got it wrong, you might want to go. but if you did poorly just because you could not remember the rule, your time is better spent studying on your own.

Some of the answers barbri provides make no sense. For instance, #11, Barbri says answer is (a), not (b). If you read the explanation, it basically states that (b) is wrong because it isn't the ONLY requirement in a negligence action, i.e., there's also duty, breach, foreseeability. However, the same could be said of (a). Why is (a) a better answer? Anyone? I can't seem to make sense of it.

Barbri does this over and over again in their practice questions. Moreover, I've seen a question where, even according to the answer, BOTH answer choices c and d must be true, yet the answer says c is right and d is wrong because d is necessary but not sufficient.
Just this morning I did a practice problem highly analogous to yours. See Intermediate Torts Question 5. It's true that landowners owe no duty at all to unknown trespassers, but it's just as true that landowners are not liable to any trespasser for conditions they are unaware of. Because the question does not make clear that the mining company was unaware of trespassers, but the question does make explicit that "[defendant] was unaware [of the dangerous condition]," it's at least debatable that (D) is a better answer than (A).
Anyway, take the Barbri questions with a grain of salt. IMO they are not written particularly well and tend to have ambiguities or even mistakes.

it would make sense for them to do so. put all the hard questions on the simulation, cause thousands of people to panic and study their asses off, do well on the easier mbe, and barbri gets to hang notices in every law school that over 90% of the people taking barbri passed.

I had written my answers down by had and scored it myself after we took it, I thought I got a 131. Either I bubbled sloppily or I copied my answers wrong.
I just finished one subject the night before, and I didn't have time to review. I did a lot worse on the second half --- a lot of stuff I just didn't know, plus I was exhausted.
I'm going to go through all my answers this weekend, review outlines properly on my specific problem areas, then try to do my own little timed exam on Sunday. I need to get this shit out of the way and focus on essays. Haven't taken wills, it's going to kick my butt.

Prior to the real thing, did you really exponentially increase your knowledge of the testing material or was the real thing just easier to obtain a higher score on? Ie the scaling is much different, not as many difficult questions..??
Also, should I waste my time attending the PMBR lectures? I plan on just doing the practice exam.
Note: I got a 130 on the Barbri Simulated.

exponentially is definitely one way to put it. when i took the practice tests, i had not memorized anything. when i took the MBE, i had memorized everything.
from the reactions to last year's MBE, I would say that the scaling on the MBE is MUCH different. everyone seemed to think the MBE last year was exponentially more difficult than the practice questions, and i agree 100%. the test was NASTY. i felt extremely under confident and i almost shit a brick when i got my score, i seriously couldnt believe it.
for PMBR, i sat through the first morning of the lecture and then was done. i took the late class so i figured my time would be better spent studying at that point. i dont learn from lectures at all, though, so thats up to you.
if you got a 130, you are in good shape for sure. my buddy got a 135 on the barbri practice and scored high 170s on the MBE.

i got my multi state outlines (with NY disctintions of course) down to about 10 pages each and then i straight up memorized them. line for line. i was an actor previously, i treated it like a script.
i did the same thing with less familiar ny subjects like trusts/wills and family law crap.
then i just studied the other subjects to a general familiarity.

For me it is a combination of visualizing the page, and hearing it recited. to memorize it initially, hearing it recited ingrains it in my memory for the short term. visualizing the page allows me to remember it in the long term.
fwiw i started memorizing multistate during the last week of barbri i think.
first, i slim my outlines and statements of law down to the absolute minimum number of words. i undoubtedly spent the most time doing this because it will make memorizing go quickly.
then, i get myself in a room where i won't disturb anyone by speaking out loud. i read the same line over and over to myself at first, then out loud until i can say it dependably without looking. then i memorize the next line, then the next. once i am done with a section of my outline, i make sure i can recite it. then move on. (i also pace around in circles A LOT while i do this...i am sure i look like a fucking moron).
i do the same thing until i have a page that i can recite. then i do the next page, and then recite both. then the third page, then the second and third page, then the first second and third page, and so on.
once i get to the end of that outline i move on to the next in exactly the same way. i start the first page of the next, and then make sure i know it with the last two pages of the previous, etc etc.
it took me about 4/5 days to memorize the multistate law, and then every day after that i would devote a few hours to reciting it, in between learning NY law. at one point or another i recited each multistate outline to my girlfriend, god bless her.
this is the way it worked for me to study. other people thought i was crazy and they spent their time doing questions and just studying. the way i saw it was that if i have the shit memorized, I KNOW i will do well on the essays because i will know the rules and be able to state them instantly, and the MBE would just be super easy. Stating the rule precisely on the essays was the primary reason i chose to memorize like this. EDIT: and when i finally got around to doing practice essays and i absolutely NAILED them, i knew i had done the right thing for me.
i knew i was not going to take this fucking test more than one time, and i knew that if i sucked it up and memorized i wouldnt have to.

it's been helping me, but I do them in two very distinct ways:
1) for learning: I do one question at a time, make by best guess, immediately look at the answer, read the explanation, highlight, make a flashcard if necessary. Rinse and repeat.
2) for testing: doing chunks of questions and 'grading' them.
the first one is pretty useful, at least for me.

yes, it's a specific type of mortgage - i.e., one that the buyer uses to buy the house. (that's why it's called "purchase money.") you can give a mortgage on real property you already own - that's not a pmm.

Yes a BarBri 103 is just passing.
It's always interesting to see how intelligent people react to hard statistical data. Here's the simple explanation for my conversion:
1. The real MBE and the BarBri simulation are both normalized tests. That is, their results are based on the competitive performance of all applicants in the test population.
2. The California Bar releases a percentile table for the bar exam.
3. Thus, if both tests are normalized, then for any given year, all you need do is match up the BarBri percentiles to the Bar's published percentile, and the coversion will put you in the same percentile on one normalized test, with respect to the other test applicants, as you are in the other normalized test.
Obviously, if you study harder and learn more than your competition between now and the real MBE, your score should rise relative to those with whom you're competiing.
But, if you were to take the MBE on the same day that you took the BarBri simulation, your score would approximate the numbers in my conversion table.
Note: the percentile table was extracted from the July 2005 exam, which was more typical than the July 2006 exam, which had an unusally high mean average.

No one is doing 100 questions per night. I'm definitely working hard and staying on the Paced Program, and there simply aren't enough hours in the day to do 100 PMBR questions as well (let alone the 50 questions they recommend). My friends are also working hard, and they haven't cracked the PMBR books yet either.
So don't worry about it, in my opinion.

Honestly, stop doing them. Your overall gain probably isn't worth it. Do some of the released questions, that will make you feel so much better. They are a joke in comparison.
At the very least dial back to the intermediate until you get the percentage up.
Also, you might be doing them when you are burned out and don't care. Try a quick set in the morning sometime, I bet your score goes up.

If you are doing CONSISTENTLY above 60-75% on all your MBE practice questions (ie 40/50; 69/100; 18/25) then you should be in decent shape for the bar. The BarBri MBE average passing score is anywhere between 100-105 - so if you scored above that, you should have no trouble.
