$240k after undergrad plus 3 years of Seton Hall law school. Can't get a good job, so I'm doing an LLM for another $55k. With interest I'll owe over $315K after the LLM. If I still don't get a good job after the LLM, I'm going to defer loans due to unemployment and travel the world on my $50k credit line. Ultimately, if I don't get a good legal job, I'll take a shitty job, consolidate, declare bankruptcy after making an "attempt" to pay, and let them garnish my shitty wage. They can only take about 15% of my wages, due to the CCPA, so they're basically fucked.
A way to pwn the lenders?
Edit: I see there are a number of people who don't get it, so I'm going to add to my post.
Option 1 = Take crappy $50k job now and pay over half my income to banks.
Option 2 = Either
(a) Get good job with LLM or
(b) Spend two years getting LLM, partying, and traveling the world in style. Then get $50k job, consolidate and declare bankruptcy. Under option two, federal law prevents banks from taking more than about 15%. As icing, the judge might even use his discretion to dismiss some of my loans or provide me other relief to protect my law license.
Thus option two = me dealing with shitty situation by fucking banks in the ass.
What's funny is that due to travel, I may even find a job in another country. That would be the ultimate assfucking for the banks.

There are a few problems:
1. Bankruptcy is an equitable remedy, so you need clean hands. If you rob Peter to pay Paul, you do not have clean hands so the whole pay off nondischargeable loans with dischargeable ones may land you in what is called an "adversarial proceeding" with the creditor and end with the debt not being discharged.
2. Bankruptcy destroys your credit for 10 years, and when the nondischarged debt becomes the subject of a wage garnishment and it turns out that 15% of your income isn't even enough to pay the interest, you find that you will have garnished wages for the rest of your life and therefore you will never be able to repair your credit. This is because info stays on credit report for 7 years from last "adverse action.." There will be a new adverse action every paycheck! Do you want to live on nothing but cash like a goddamn drug dealer for the rest of your life?
3. Everything you ever buy like a car or house or whatever from now on you either won't be able to get it or the interest will be like 30%+ cuz of your horrible credit. So getting that house to live in to grab the homestead exemption will be a tough proposition. C'mon you can't buy a house with a credit card, even if the limit is high enough (which I doubt could be, where even in FL can you find a 50k house?).. So since you don't own a home you must rent but OH NOES, most landlords check credit reports!
If you do this, yes, less of your income goes to loans. But in exchange you have no credit and are either homeless or renting from from a very shady asks-no-questions type of landlord. Bad call dude. And there you sit, alone, under your one bare light bulb, for the rest of your life.

If you're not even paying interest on debt, then you've effectively gotten out from under it. Say you lend me $350,000 and the monthly payment is $2,500 a month, but due to wage garnishment and my shitty salary, I only have to pay you $500/month. Then it doesn't matter if the principal is going up because the debt is effectively discharged until I make good money.
I don't know what point you're trying to make on the wage garnishment stuff, but those are state and federal law (e.g. CCPA.) Basically, they can take a MAXIMUM of 25% of my DISPOSABLE (note I didn't say gross) income. They take a lesser percentage if I don't make much money. What point are you trying to make in your incoherent ramblings?

Regardless, explain how your situation fits either of these:

[If you have a 50K job, you will not fall under any state's median income, as far as I'm aware. You also will clearly be able to pay $100/month on outstanding debt. Thus, in order for this plan to work you'll need to get a $30K job or perhaps even lower].

Bingo, there isn't. But why bother declaring BKRCY at all? Either way, you're going to end up paying back not-that-much each month.
I think you could negotiate with your creditors to just pay back a pretty low amount each month and your credit wouldn't be great but it wouldn't be bad and your pmts would be low.
If you declare BKRCY, its the same but you'd have to file the papers, etc. More work for you.

Edit: I also think the garnishment cap only applies to one garnishment at a time, not aggregate. If you have multiple garnishments, I think they can rise above that, but I readily admit I'm much fuzzier on non-bankruptcy stuff.

Having read up on the CCPA, you're absolutely right, they'll only be able to take 25% of our disposable income (which looks to just be your net income, because it seems the only thing excluded from disposable income under the act is tax liability). However, (1) they will take this from you forever, and (2) you'll never own anything of value because outside of bankruptcy creditors will grab it, and (3) your credit will be ruined for life (although you seem not to care abotu this last one). My intuition is strongly telling me, no. As long as she makes the down payment and she makes the payments, it would be OK. He would just pay for their food, cars, and other "basics", never pay for the house. In the long run, if the value of the house goes up, when they sell it maybe he could use that to settle his debts.
My intuition STRONGLY says that if she buys the house and handles the payments, they won't look beyond that. Most states provide very strong protections for homeowners. If the house is only in her name, they cant look past that. But, the rub is, if they ever got divorced or anything like that---she gets the house.

I just have a hard time believing you can partition a married couple's finances like that. Why wouldn't all married couples do that at the first sign of financial distress? If I were married and my house was about to be foreclosed upon because we couldn't afford to pay all our debts (but could afford the mortgage), why wouldn't I "sell" the house to my wife, have her pay the mortgage every month, and I take on the credit cards and other bills, and default? I fell like this would happen a lot more often and no one would file for bankruptcy.

But many people put 2 names on their leases/mortages. You don't have to, but many people do this. Obviously, we don't penalize people in this country for marrying someone with bad credit. Of course it makes life harder when 1 person has to sign for the big purchases, but in your case you'd have no other choice.

Obviously you can't "sell" your house to your wife. That's not allowed because of look-back periods. That's something they look for routinely in BKRCY proceedings.

If she owns the house and its not really him making all the payments in some obvious way, then its fine. In fact, for couples this is a common issue of contention. If one spouse makes all the income, the other one needs to be listed on the mortgage or the entire house goes to the other spouse if they divorce.
If you're on the mortgage, its your obligation. As a practical matter, his wife could have a job and pay the mortgage and he could hand her cash for other stuff.
You're wrong that your spouse's credit necessarily affects yours. It does not. However, many people have shared obligations... both partners are often on the mortgage, for example. But if your wife leases a car or has a cc bill, unless you're a cosigner or you're on the lease, its not legally your problem.

I don't know the answer about community property states but I really doubt community property means that a house that his wife has a mortgage on would be his property or obligation. I also doubt that community property is so rigid that his debt becomes his wife's debt also. I just can't see that being the case. Seems very harsh and formalistic.
Interesting question, though. I honestly dont think there are easy answers to this guy's hypo. I dont think its some silver bullet for him, but I think him paying 80% of his disposable income sounds as bad or worse.

It's not 80% of his disposable income to pay the minimums over 30 years, esp. when inflation will eat at that as his salary increases.
The fact is, within 5 or 10 years, with inflation pulling his real debt down and his salary rising relative to inflation, he'll probably be below the 25% threshold that he would be at through garnishment/default. However, he'll actually maintain good credit and will be free of his loans in 30 years.
Ok, let's say you're right. He meets a nice girl, wants to get married. "Umm, honey? Could you buy every decent thing we own? You see, I decided to fuck the banks up the ass, so we can't have nice things unless you buy them. Aren't you proud of me? OK, but I think the OP's thesis has some merit. He may be right that he won't able to pay back 250k in debt. Let's say his monthly payment should be 1500/month. Well, if he doesn't pay it, they have to go to court and get an order to garnish his wages. If he really can't make enough to pay that back, they'd have to accept a lesser amount or else garnish him. That would be a lower amount than 1500--probably much lower, bc its computed using disposable income.
He's not going to have it "easy" either way. But he'll also likely never actually pay back the 250k + interest. He'll essentially just have to keep giving away 15-25% of his income. In the long run, that might be better plan than turning over almost ALL of your disposable income in a futile effort to pay off your debts.

of that 3000, he *could* pay 2000/month and live like a hobo. it would take him forever to pay off his loans, assuming they're at 7% interesting or whatever. he'd probably be on a 30 yr repayment plan and he'd probably pay it off in like 15-20 yrs, even if he was paying 2000/month.
now assume he says "fuck that" and seeks protection. his credit gets ruined, no doubt. but insetad of paying 2000/month, he literally pays 15-25% of disposable income. let's say they assume that 2000 out of his 3000 net income is disposable. so at 25%, he'd pay 500 or so per month.
Maybe its worth it to him. He couldnt buy "stuff", he'd have cash though. With the cash he could live decently. I dont think they could take his tv, computer, furniture (normal furniture), or stuff like that. He just couldn't start buying art or collecting valuables or buy a boat, etc.
Yes, it sucks, but it seems like he could end up paying just 500/month or so for the rest of his life. They'd never get their money back (with interest) and when he dies, then they write it off.
Seems like a huge waste, but I really don't t hink anyone can force him to aggressively pay down a mountain of debt like that.

GL finding a chick that is cool with living like that. Also, if he were to marry, would her property/ wages be in jeopardy too? It's like they'd have to pay a 25% tax, on top of their taxes, for life. In the end maybe that is better, month to month, than paying the debt off normally, but it's FOR LIFE. So in year one you are better off with garnishment. If you get a 6% (not unheard of if you are a government prosecutor or if you work at a firm) raise each year, the amount of money that is 25% of your income will increase and thus your garnishment will increase. Meanwhile, your minimum will remain constant, and will become an ever shrinking proportion of your salary. By those figures, in year 10 you will be about $90 short of breaking even with the garnishment ($17908 as 25% of income vs 18000 minimum) and you'll be better off in year 11. If your raises are smaller or the minimum is higher then it will take somewhat longer but it's doubtful even with some bad numbers that you'd still be worse off under the minimums at 15 years. Of course, actually having good credit and never having to fear sheriff sales are an added plus. The fact thatyour TTT brain couldn't conceptualize this without numbers is pretty fucking weak
Edit: Let's not forget that under the minimum payments, you will actually PAY THE LOAN OFF at some point. There's no guarantee of that under your garnishment scheme. First, at least initialy, you probably won't pay enough to cover interest, meaning your principal will grow during the first few years until your 25% of disposable income catches up with the size of the interest of the loan. Also, becase you've defaulted, the bank will tack on tons of penalties that will increase the principal further. It is fairly easy to foresee a scenario where you will have your wages garnished for far longer than the term of the loan, even though, at the back end, you'll be paying much much more than the minimum payments. Thus, under your brilliant fucking plan, you'll both pay MORE and pay LONGER than you would if you just made the minimum fucking payments from the start.
To Recap, hypothetically:
Scenario 1: You pay the minimums, which is a flat rate every year that over time becomes a smaller and smaller percentage of your salary. You maintain good credit, and pay the loan of at the end of the payment term (say 15 or 30 years). You have no penalties from the bank because you haven't defaulted. You may even be able to find a wife, because you won't have to ask her to buy all your nice things.
Scenario 2: You default, bank takes all your valuables that are not exempt from sale, and garnishes 25% of your dispoable income. The bank also tacks on default penalties. Over time, you pay more to the bank than you would have, and you continue to pay long after the payment term would have expired. You have ruined your credit for essentially your entire life, and you will have to explain to any woman with whom you have a serious relationship that you're a financial fucktard.
I really like how you fuck the bank in the ass in scenario two by paying them more money during the payment term AND continuing to pay them long after the term would have been over. I'm sure all your friends will be proud when you explain the bank's utter defeat at your able hands.

By those figures, in year 10 you will be about $90 short of breaking even with the garnishment ($17908 as 25% of income vs 18000 minimum) and you'll be better off in year 11. If your raises are smaller or the minimum is higher then it will take somewhat longer but it's doubtful even with some bad numbers that you'd still be worse off under the minimums at 15 years. Of course, actually having good credit and never having to fear sheriff sales are an added plus. The fact thatyour TTT brain couldn't conceptualize this without numbers is pretty fucking weak
Edit: Let's not forget that under the minimum payments, you will actually PAY THE LOAN OFF at some point. There's no guarantee of that under your garnishment scheme. First, at least initialy, you probably won't pay enough to cover interest, meaning your principal will grow during the first few years until your 25% of disposable income catches up with the size of the interest of the loan. Also, becase you've defaulted, the bank will tack on tons of penalties that will increase the principal further. It is fairly easy to foresee a scenario where you will have your wages garnished for far longer than the term of the loan, even though, at the back end, you'll be paying much much more than the minimum payments. Thus, under your brilliant fucking plan, you'll both pay MORE and pay LONGER than you would if you just made the minimum fucking payments from the start.
To Recap, hypothetically:
Scenario 1: You pay the minimums, which is a flat rate every year that over time becomes a smaller and smaller percentage of your salary. You maintain good credit, and pay the loan of at the end of the payment term (say 15 or 30 years). You have no penalties from the bank because you haven't defaulted. You may even be able to find a wife, because you won't have to ask her to buy all your nice things.
Scenario 2: You default, bank takes all your valuables that are not exempt from sale, and garnishes 25% of your dispoable income. The bank also tacks on default penalties. Over time, you pay more to the bank than you would have, and you continue to pay long after the payment term would have expired. You have ruined your credit for essentially your entire life, and you will have to explain to any woman with whom you have a serious relationship that you're a financial fucktard.
I really like how you fuck the bank in the ass in scenario two by paying them more money during the payment term AND continuing to pay them long after the term would have been over. I'm sure all your friends will be proud when you explain the bank's utter defeat at your able hands. Your defense of this flame is at an end.

Garnishment isn't going to take 25%. 25% is the maximum they can garnish off of your disposable income. Maximum. Disposable. Thus there's no way they garnish 25% to start. That's like saying a poor person will pay 35% of their gross income in federal taxes. It's just a ridiculously erroneous application of law to facts.
Also, numbers look like this: Column 1 - 40 years' take home salary with the first plan. Column 2 - 40 years' take home salary with the second plan. I know you can't develop them, because you can't do arithmetic, or calculate a loan payment, but that's what it would look like if you could. Prose =/= numbers.
If you get a friend to help you apply the law and work through the numbers - you'll see that while the person is poor, he's far better off with garnishment. Then once he's rich, he'll be worse off with garnishment, but it won't matter - because he's rich. In economics, this is called utility theory.

1. Disposable income in the garnishment context = your post-tax income. It is not disposable income in the sense that it is over and above the income you need for subsistence; pretty much the only amounts outside of disposable income for the purpose of CCPA and state garnishment laws is tax payment.
2. If you are making 50k, which is significantly higher than any state's median income, are you really stupid enough to suggest a court would take pity on you and make you pay LESS than the maximum garnishment cap? You make me think you actually do go to Seton Hall more every minute. 50k, while poor by most lawyers' standards, is actually doing well in the eyes of a state court judge used to dealing with REAL poor people everyday who can't pay their debts. You will absolutely pay that 25% maximum, from day one.
3. I'm not going to sit down and create a forty year chart. I did the math. You can't refute that under the scenario I laid out, you lose. Your only recourse is to say that yes, you lose eventually, but while you're "poor" and young you win, which is better. Here are the problems with that theory:
4. First off, you will not be "rich" when your 25% garnishment eclipses the minimum payment. You'll be taking home about 70-75K, IN 2018 DOLLARS. Put that in real dollars, adjusted for inflation, and you'll have the purchasing power of someone making less than $55,000 in 2008 dollars (assume 2-3% inflation over ten years...I've done the math, before you try to say otherwise asshole). Thus, because the garnishment is a set percentage of your income, inflation will actually work against you relative to making fixed minimum payments. So, while your nominal wage will increase, your purchasing power will only rise slightly, and all of that rise AND MORE will be eaten up by the fact that you are paying well above the minimum and the gulf between the garnishment and minimum will only increase the further along you go. So there you go. Not only will you not be "rich", your financial situation will actually get WORSE as you get older. This isn't something that will happen 30 years down the road...it will happen in ten years or so. The idea that you would only see negative consequences from this when you become rich is a logical fallacy.
5. All of the above really only gets into the disparities between the plans during the term of payment, and shows fairly clearly that you come out a net loser over the normal life of the loan. However, as I mentioned above, the garnishment plan will make you pay WELL BEYOND THE TERM OF THE LOAN. So, you'll pay more during the term, AND continue to pay, IN INCREASING AMOUNTS after the loan would otherwise be paid off. AND you'll be paying back the gains you make initially, which will increase your principal (and therefore interest on that principal), AND oyu'll be paying default penalties that in many instances increase the principal by exorbitant amounts (if you remember a thread that was here about a year ago there was a grad student who killed himself after he defaulted on his student loans; I remember that his penalties on his loans were in the high five figures. This amount wll be tacked on fairly early in this process and build interest throughout).
6. Finally, part of the fun of your plan, in theory, was that it would fuck the bank over. However, it's almost a certainty that, short of you dying prematurely (which would fuck them whether you default or not), you will pay them much much more money under your theory.
BTW: You're the one trying to cling to a shitty theory you thought up that isn't particularly difficult to formulate, but *mysteriously*, no one has ever executed successfully. You think if this theory was actually a good decision people wouldn't have done it and this community of people with gigantic loans wouldn't have heard of it? Now who's the one clinging to their wrong answers like a pathetic faggot?
Edit: Don't pretend like you know anything about economic theory, either. You've got to be kidding me. If his purchasing power decreases over time, the utility of the increasing amount of income that is taken out will increase. He will have to pay more when he is poorer. While a present value of money argument may be better, that will be pretty easily overcome by exorbitant default fees and increasing principal. While he will temporarily be better off at the beginning (see above I never said otherwise) his financial situation will fall off a cliff and he'll be forced to pay more as his purchasing power remains constant and eventually increases
