At graduation I'll be clerking for MJ.

I also have professors willing to make calls for me.

Would MJ and then dist. the next year open the COA doors up a bit? Assume I don't give a fuck which judge in which circuit.

Summer work was all government work at the federal and state level.

According to someone I know who ran some math shit on the clerkship data, a year of work before clerking is like a .5 boost in GPA. No idea how true that holds.

Just depends whether your MJ has good connections and is respected by Dist Ct judges--if so, and he goes to bat for you, his rec will carry a lot of weight.

The same would be true for any dist ct judge you got, although it would be pretty miraculous if you got COA with your school/grades combo. Still, personal connections go a long way.

Thank you to both of you. You've confirmed what I thought would be the case were I to try to get COA eventually.

One of my recommenders told me getting COA was definitely doable after a MJ and dist., and he's got a lot of pull and is a rather prestigious professor (SCOTUS clerkship, lots of national connections, prolific publisher, etc.). So I'm hoping that he's willing to go to bad for me in a little over a year for COA purposes.

COA judges sometimes take note of opinions from good magistrate judges. So that factor, plus your SCOTUS recommender, probably would give you a better chance than usual (although I still think it's slim).

On the other hand, by the time you finish clerking for a MJ + district court judge, you'll likely have gained all the knowledge you'll need from clerkships. So a COA clerkship would not add much; and thus there isn't much of a risk in embarking on this trajectory.

This is also true. But, conversely, they know which magistrate judges they dislike, too. Attempting to go to a COA in your magistrate judge's district can be risky for that reason. My judge could easily pick out the good and the bad judges and magistrate judges, from her perspective.

My MJ is definitely well-respected by everyone in the area. Well-liked and professionally respected. Apparently politically connected as well, although I didn't know that at first.

I'll work my SCOTUS recommender. I consider the prof. close personally and academically. Multiple classes, multiple lunches we've shared, and he's been effusive in his compliments toward me and how my grades are absolutely not reflective of my potential.

Now I completely recognize that many judges and clerks are likely to say "median at T20? Trash." without even looking at anything else. I suppose this is where the phone calls come in?

Now, at my university, there is very little GPA difference between median and the top 1/3 dividing line. It's entirely possible my last semester will be better and I'll jump up to cum laude and top 1/3. Would this improve my chances? Or will it make very little difference in the context of my other factors?

Thanks. I'm concerned about getting a COA because I'd like to shorten my time before I can do BIGLAW appellate work. I figured a COA would help me skip "putting in my dues" before moving from litig. to appellate.

My understanding is that in BIGLAW you usually don't get put in an appellate section right away. I wanted to hasten that "appointment."

If I don't get COA it's not the end of the world. But I'm hoping I can get into BIGLAW with the MJ and dist. clerkships. I've been hearing all the shit about COA clerks getting offers rescinded, and I am worried about that happening to me a couple years from now.

Hopefully the economy is doing moderately well by then.

Depending on the judge, some of the New England courts are highly competitive. Worth a try, but definitely talk to EVERYONE at your school.

D.C. COA might be a reach, but if you have profs willing to call for you give it a shot. Try for Ninth Circuit, of course, although the lack of LR hurts a bit.

See where profs you know have connections--if a prof used to teach at UT, for example, see who he knows in Texas. If he clerked for a COA judge in Texas, even better. This should get you COA interviews.

You folks need to stop giving such optimistic advice. The clerkship market is brutal, and many (if not most) go to students whose recommenders have connections and make phonecalls on their behalf. Even at the T14, top 20% is not good enough for a good district court without connections.

It's just so impossible to think this way. Let's say the band if 20% for CLS, 25% for Chicago. Would you actually choose Chicago because of the chance you'd land between the top 20th and 25th rankings in the class? Probably not.

If you want to teach, you want to go to Chicago. But, again, what are the chances you end up in the top, say, 8% of Chicago, over, say, the top 3% of Columbia?

These are just far too abstract points for the long-term. If these, cumulatively, weighed against Columbia, maybe. But you can't just cite X factor like a TLS poster and think, "There it is!"

Talk to those profs about how much you want a clerkship, and see what they will do for you.

It's a fine plan to try for dist ct --> COA, but consider also applying to COAs this year so you can do them in reverse order. COAs might respond more positively to certain credentials, like the EIC thing. And, if you start with an appellate clerkship, you should also be able to apply to better dist cts for the following year.

Consider applying to COA judges in places where people don't want to live, like Detroit.

You don't necessarily need an extremely well known prof. It's better if they know you well and can say a lot more than "booked my class." That said, many judges rely heavily on recommendations from profs they know and trust. Ask your profs if they have any connections to the judges you are interested in (or obversely, get interested in the judges with whom your profs are personally acquainted).

Both are probably tough. You'll really have to milk some local connections. See what judges out there have taken UVA clerks in the past, or even interviewed. I don't know many CDCA judges are going to bite, though. If you had gone to OMM or Irell or something straight from UVA, that'd be one thing. But it looks more like a guy trying to get out of his job or something. Going to take some legwork to network.

The first would make a HUGE difference; the second, barely any.

Most chambers receive 500+ applications, so like it or not arbitrary distinctions help narrow down who will be interviewed. Of the chambers I know of, most do some type of sort using grades/journal/school.

For clerkship purposes, only Chicago gets you much further, since MVP all have home markets that don't compete as heavily with those from HY.

There's a big difference between top 10% and top quarter, but even top quarter might work out for you if you were on LR. For better or worse, LR is the single best credential you have in LS. Being on LR also makes your 2L GPA look better, since you managed to achieve those grades with a sometimes massive amount of work coming from non-class work. On workload, secondary journals simply can't compare.

Depending on where your law school is located, you might have an excellent chance. I know several T3 COA clerks.

Many non-feeder COA judges hire 1 or 2 clerks from nearby law schools each year. If a judge works in a rural region of the country, the nearest law school will often be a T3. Of course, this is rarely the case on the coasts or near major markets.

A legit shot, I'd say. Top couple percent with WE. Just make sure you express a real passion for clerking and aren't just looking for a parachute out of your dead-end job. That's what a lot of people are doing these days. Make sure to play up your local connections and what you hope to learn. Don't phrase it as "less-desirable" location; play up how great a place is, why you're connected there.

Lots depends on the DCt in the first place. Decent shot at it, ensure good LORs and focus on the local connection. Leverage depends on DCt, if you get the judge on your side, etc.

Out East? It will be tough; for SDNY/ D.D.C. you will need profs to call their judge buddies. Local COA is easier for a magna at the top school in the state.

There is some value in the fact he interned for the judge, because in theory the judge knows him well enough to recommend him to a COA judge right now--and if he's looking for COA in 2010, he should be applying before he begins his clerkship.

That said, unless your judge is especially well-respected it will be hard to move up.

CCN. Somewhere around the 10th percentile. Secondary journal, ed board but not EIC. Good recs from profs I've worked with one-on-one, but no one is going to call and say "this kid is the best I've seen since...".

2L classes indicate strong interest in transactional law--no evidence, fed courts, etc, but I do have tax, corps, securities, etc.

I had lunch with a prof recently who is a member of the elect, and he confirmed that a rec or phone call from even a MJ you formerly clerked for is a huge advantage when you're trying to get a COA clerkship.

It's hardly any more length to include the vol. no. and page no., and then clerks can go find it. If it's just 1 piece, or 1 piece and some bar journal garbage, probably leaving it under education.

earlier this summer, around late july, early august. no DCt this yr, i'm starting at my firm in 1-2 months. i'm not sure of this myself (and won't get any more specific than this), but 1 of my profs indicated that my firm's presence on my resume might have boosted my chances a bit.

IIRC, you said you targeted only feeders or highly desirable locations w/in those circuits. You probably would've wound up with something had you applied more broadly.

But also IIRC, you said you're fairly happy where you currently are, so this was hardly make-or-break for you unlike for many others. In any case, best of luck next yr (or whenever ITE blows over).

I didn't target only feeders, but I didn't apply to Idaho or the 10th outside New Mexico and Colorado. Other than that, I applied to everyone.

rly sorry dude. on the bright side it looks like some judges have already opened apps for 2011-12. maybe you can polish your app quickly and catch them (and all those who hire before summer) at an earlier point in the cycle than you did this past round. sux that ITE rly blows. best of luck.
