Student debt has long been considered difficult, if not impossible, to discharge in bankruptcy. But that hasn’t been the case in recent years, a new study finds.

The success rate for student loan borrowers who attempt to discharge their debt in bankruptcy has “jumped” to 87%, according to an analysis published in The American Bankruptcy Law Journal this month.

The improved outcomes for student loan borrowers in bankruptcy stem, in large part, from updated bankruptcy guidelines the Biden administration issued. In November 2022, the U.S. Department of Education and the Department of Justice rolled out a policy that experts say treats student loans more like other types of debt in bankruptcy court. Borrowers can fill out a 15-page attestation form, detailing their financial struggles and making their case for a mulligan.

The Trump administration has not rescinded that guidance. The Education Department did not respond to a request for comment.

Also what “no loan forgiveness” are people talking about? I got PSLF in the summer. $300k (only took out $150k but interest) forgiven after working 10 years. If you don’t get biglaw just get some government gig that you get raises to $200k+ plus pension and get your shit forgiven in 10 years. No idea why this is such a hard concept. No it’s not biglaw money but it’s literally a way out.

People are so stupid to stay in the private sector if you strike out at Biglaw and stay in the private sector with $200k of student loans. Everyone I work with got PSLF. By the time it’s forgiven you’re 36 and can still move on with your life paying probably $20k of the total balance over 10 years.
