There are not the same, hence why it's peppered with "either" and "or." The ability to conform element just means that even if you know it's illegal you're not responsible if you have an irrestible impulse and can't conform.

If half the jury believed she knew it was wrong and half believed she didn't but knew it was illegal and could control herself, she's responsible. Wtf is the significance of "merger?" |
