This is the federal court that’s ruling this week or next on whether to issue a preliminary injunction blocking Trump’s tariffs
It’s an Article III Court comprised of nine judges. However, by statute, no more than five of the nine members can be from the same political party:
“The President shall appoint, by and with the advice and consent of the Senate, nine judges who shall constitute a court of record to be known as the United States Court of International Trade. Not more than five of such judges shall be from the same political party. The court is a court established under article III of the Constitution of the United States.”

So that’s pretty weird, and possibly unconstitutional.
But that aside, how exactly does an Article III Judge declare their membership in a political party? And what prevents one from pretending to be from a smaller third party while having allegiances to one of the two main parties so as to in effect give that main party more than five judges on the court?
Btw this is the only Article III Court in the entire country that has a statutory limit on the number of judges from the same political party.
