- If she gives birth on the ice, it would be impossible to contest such a penalty coming after the birth. There is literally an extra person on the ice.

- However, if she has an abortion on the ice, then no, it was never a person.

- In the case of an intentional miscarriage on the ice, personhood of the fetus and the legitimacy of the penalty may depend on jurisdiction.

- Otherwise, any penalty could be held in potentia until the time of a live birth, in which case the results of the game could be litigated.

Has the midget been born? Yes, so it's a legal person and can't go on the ice without drawing a penalty. However, a player could go onto the ice with a corpse strapped to his back because it's no longer a person.

But if you don't touch the ice you're not "on" the ice imo. The NHL needs to close this loophole. Teams could also use players hanging above the ice on harnesses to gum things up on defense
