Torre's argument - We know Kawhi Leonard was being paid for a no show job, Ballmer invested $50 million in the company, Kawhi got $28 million from the company and did nothing, and I have 7 employees saying they knew it was to circumvent the salary cap. Also, the Kawhi contract said it was terminated if Kawhi was no longer a Clipper.
Cubans argument - Ballmer isn't dumb enough to participate in this hair brained alleged scheme of salary cap circumvention that would obviously get reported immediately, and if he was that dumb, he would've cured all these deals before they went public in bankruptcy. Everything that the employees "knew" about this scheme was from their employers, who are known lying scam artists.
--I tend to side with Cuban. Torre's version of event seems like how non-corporate people think corporations work, while Cuban is more based on the real world. It'd be really dumb for Ballmer to do this in someone else's company that was about to go public.

Guy who never did AN INTERNAL INVESTIGATION FOR A MAJOR CORPORATION
we definitely had occasions where the guilty employees were like yeah I did that and that but was just bullshitting about that other thing.
Those were always fun to explain to the DOJ!

Torre's argument was that it came from Ballmer and everyone knew they were circumventing the cap.
Cuban argument was that the company had a ton of fake transactions, so its possible the execs told them it was the NBA salary cap circumvention rather than outright fraud (which they were definitely committing).

Several times he kept trying to trick Cuban by being like "Would it make a difference to you hypotheticall if it was $50 mm??!?!?"
And Cuban never took the bait and was just like, "No that doesn't really change the logic of it."

Explain to me the tree guys incentive to give away 28 million of their scam away to Kawhi for nothing?
Pablo doesn’t do a good job nailing down the logic in his interview with Kawhi, but Cuban’s logic is even dumber.

Its unclear.
We do know that for other celebrities, they would pay the celebrity $10 million in "endorsements", then the celebrity would pay tree guy $9 million for trees, and the tree guy would report that as $9 million in revenue to go out and get more investments.
Torre seems adament that Kawhi's endorsement was not this same scheme - but he seems to oblivious to the fact that if we know this scheme exists, its perfectly plausible Kawhi's camp agreed to some completely different hairbrained scheme.

It seems pretty obvious that there’s enough smoke that the nba needs to investigate this at least as thoroughly as Baylor investigated Art Briles.
They need to hire an independent investigator and require the Clippers to turn over all emails and whatever documents the investigator deems relevant and make all employees available for interviews.
