ok, serious question.
if a protestant has a confirmed valid baptism (trinitarian) and has just practiced the sacrament of confession albeit with a clergyman who is not validly ordained (ie confessed to their shitprot pastor)… are they sufficiently graced such that they can receive communion? if no why not? interested in technically correct answers only pls

No.
See below. Not valid confession = no confession.
Admitted to the Church? If NC of Poland/Orthodox there is some necessity required but it not strictly prohibited, provided that person would be admitted to Communion in his/her church. Protestants are right out.
If the "clergy" does not have apostolic succession then they are not clergy and do not perform any valid sacraments anyway.

THE MINISTER OF THE SACRAMENT OF PENANCE
Can. 965 A priest alone is the minister of the sacrament of penance.
Can. 966 §1. The valid absolution of sins requires that the minister have, in addition to the power of orders, the faculty of exercising it for the faithful to whom he imparts absolution.
§2. A priest can be given this faculty either by the law itself or by a grant made by the competent authority according to the norm of can. 969.

Must have holy orders to have a confession. Anglicans, Orthodox, (Eastern Orthodox?), NCP--(maybe more?) have that (generally). Baptists, etc do not. Inquiry can end there.
There are exceptions for grave circumstances and general confessions before death, etc. But for someone who has not confessed for 5 years-- I don't see how grave circumstances could persist for so long.
I'm simplifying here, of course. But there are reserved cases in which the Bishop must perform the confession or specifically authorize the priest to grant absolution. I believe apostasy is reserved.

Are you in communion with the Church of Rome, or in a church that recognizes the Real Presence (and has apostolic succession)?
Have you been baptized?
Have you validly been admitted to Communion?
Are you in a state of grace?
If you are a lapsed Catholic, arrange a private confession and explain the reason for the necessity (regular confession is not ideal for a lapsed Catholic since the time required will be unusually long).

St. Paul said that everyone must be aware of themselves prior to eating the eucharist, and that the eucharist destroys those parts of people that are impure, and that this destruction is the reason for so many people getting sick and dying.
The Church seemed to take this to say that one must be in a state of grace prior to taking the eucharist, which requires confession for all sins the Church has denoted.
Personally, I've always wondered whether acknowledging one's sins is sufficient to not be harmed by the eucharist -- why does this require confession if St. Paul only said that people must be aware of their sins (not confess them).
I know that there is a commandment in Acts of Apostles, I believe, to apologize publicly for one's sins (and the act of confession takes care of this), but I don't see that as a requirement to take the eucharist. It seems contradictory to the Lord giving his body to us sinners freely -- one does not need to be in a state of grace to receive the Lord -- rather, he is a savior for us sinners.

Interesting, but its moot.
If the Church says that you need to be in a state of grace, then you need to be in a state of grace. period. This it the benefit to having a hierarchical magisterium, neither of us is in a position to fully parse the issue.
Id go one step further and ask why you would not want to be as close to God as possible prior to drinking Christ's blood and eating his body? One should not only be in a state of grace, but fasting prior to reception just makes sense.

sorry to hear that brother.
not Catholic, but your circumstances seem like a good reason to seek out regular confession anyway (formally from an unmarried priest…? I’m not Catholic so I’ll not comment). you feel that your circumstances are unfair, and you’re probably right, but you’re using that to justify shutting down instead of getting pastoral guidance that could help you both clear your conscience and probably do some good with your marriage. I’m guessing your resentment is only growing.
not trying to be judgmental because I too am married and realize its never ever easy to reconcile where sex or money are involved.

“We must not,” writes St. John Cassian, “avoid communion because we deem ourselves to be sinful. We must approach it more often for the healing of the soul and the purification of the spirit, but with such humility and faith that considering ourselves unworthy… we would desire even more the medicine for our wounds. Otherwise it is impossible to receive communion once a year, as certain people do… considering the sanctification of heavenly Mysteries as available only to saints. It is better to think that by giving us grace, the sacrament makes us pure and holy. Such people manifest more pride than humility… for when they receive, they think of themselves as worthy. It is much better if, in humility of heart, knowing that we are never worthy of the Holy Mysteries we would receive them every Sunday for the healing of our diseases, rather than, blinded by pride, think that after one year we become worthy of receiving them.”
