one of the appellate judges wanted to let the court below know that he sees an easy PC issue. who knows if the other two appellate judges see it that way.
the presiding judge below, Schiltz, was dealing with his mentally disabled kid when DOJ asked for a quick reversal of the Magistrate judge's decision.

I've had cases where the Mag CLEARLY misstated the law, and the District Judge still followed his ruling by saying that the error was "Harmless". |
