I presume the COA judge would not be on the panel for the appeal. Maybe he could be sitting en banc. |

1. Extremely Boomerish dissent. There's no reason this couldn't have been trimmed down to 20 pages.
2. Having said that, Jerry Smith has been one of the biggest COA > SCOTUS Feeders for decades. Libs might be laughing now, but this guy unironically has the ear of several SCOTUS Justices and he seems EXTREMELY PISSED about how all of this went down, on every level. When this decision inevitably gets appealed to SCOTUS, I'm not sure things will ultimately turn out the way libs are hoping they will. We'll see what unfolds! |

The complained-of conduct--at least the conduct Judge Smith is leading with--is that the majority didn't let him see a draft of their opinion until shortly before they issued it (with a note that Judge Smith would be appending a dissent).
