It's the immunity that applies to judges and (in certain circumstances) prosecutors and legislators.

i have no idea if absolute immunity applies to the MN killing.

in general, though, the question of whether something is in the scope does not turn on whether policy was violated.

that's the entire point, and the power, of absolute immunity. there is no need to decide whether a judge or legislator who is following policy should get immunity.

the entire issue arises when a judge or legislator is doing their job and massively errs.

i'm not sure you and i are focusing on the key issue.

absolute immunity becomes an issue when someone arguably fucks up. it doesn't become an issue when someone follows policy.

so if a judge makes a massively erroneous ruling but wasn't bribed, etc., then it was within the scope of the job but was outside policy -- and the judge gets absolute immunity.

absolute immunity is quite rare, as i understand it.

qualified immunity is more common, but even there it is broadly applied. cons have wanted to trim back or even decimate QI but libs have opposed that.

I'm stupid so please bear with me: if there's a written agency policy that says "don't shoot moving vehicles," but an agency official shoots into a moving a vehicle, can the agency official still claim he was acting within the scope of his duties?

that's my understanding, yes. AI is a doctrine for fuck-up situations. but if you're doing more or less the official function, even if you get it wrong, it's within the scope.

If he accidentally shot the driver I can see it, but this guy had extensive training and indemnifying him is a bad look for any employer. I guess I'll leave it there

Vance on Jan. 8: "You have a official engaging in federal law enforcement action. That's a federal issue. That guy's protected by absolute immunity."

Vance today: "I didn't say that officers who engaged in wrongdoing would enjoy immunity. That's absurd."
