Trial starts and we basically win on our motion in limine because the other side admits they have no evidence to offer on the issue (despite opposing our motion). Instead of just taking the win Boomer argues the Motion as if the Judge ruled against us. Client is sitting next to me asking WTF is "Boomer" doing? This goes on for like 7 minutes before the Judge is like stop you won.

This is a one-day bench trial and each side has one witness. Pre-trial we agreed that Boomer will cross their witness and I'll do direct of our witness. Half way through their witnesses testimony Boomer realizes he doesn't have a good handle of the facts (because I'd been doing all the work) and whispers to me asking if I want to do the cross. Of course I say yes because I don't want him the fu-- it up like he did earlier with the motion in limine.

Despite never having questioned a witness in Court (I've done a bunch of depos) I did okay on cross, then I handled our witness.

Judge just issued a bench ruling and my client pretty much won on all his claims plus attorneys fees which are provided for in the contract we were fighting about.

I have no idea how this Boomer has been doing it for 40 years (either he's slipping or he's always let others do the work and it great at claiming credit).

And my big takeaway from the trial is I hate litigation...

Conducting a proper and competent cross that hits points and doesn’t get jammed on objections that have to be ruled upon is an objectively more valuable and scarce skill set. Many “think” they can do it: dunning Kruger is a powerful attractor on this point.

And this is a skill that you really need to practice to perfect. Looking back at this trial a day later I'm like I should have asked X when he said Y, etc. Obviously the result was what the client wanted but I am far from a polished cross-examiner.

Congrats on examining a witness brother. Cross is hard (at least it is for me because nlrb litigation is trial by ambush - no discovery so you have to furiously write notes as the fgt testifies). Sorry about the boomer

Ten gdc bench trials and 3 multi day jury more or less. I’m 20 years in. I used to do about 25 gdc trials a year but I’ve moved up in the world.

In a typical year I typically work up and settle about 5x that on each. You can settle the clear winners when the money is right.
