Former New York City Mayor and new member of President Trump's legal team Rudy Giuliani said Wednesday that Attorney General Jeff Sessions and Deputy Attorney General Rod Rosenstein should end special counsel Robert Mueller's investigation into Russian meddling in the 2016 election.

"He never expected this from Jeff," Giuliani told Fox News host Sean Hannity Wednesday night. "The two of them can redeem themselves, Sessions and Rosenstein, they should order the investigation over."

Rosenstein, the No. 2 official at the Justice Department, is overseeing the probe because Sessions recused himself.

"To watch this happen under a man I love, Jeff Sessions, I just feel bad. I know the president is heartbroken over this," Giuliani said.

Trump hates attorneys who actually do legal work because they're quiet and careful about what they say (and what they want Trump to say). When conducting an investigation, agencies typically have an obligation to the public to allow the investigation to proceed in a totally impartial manner. No one is supposed to advocate for the agency's position on any given issue, since the investigation itself is not considered adversarial.

Here, the attorney overseeing the investigation previously advocated for certain agency actions that are at issue in the investigation. It's not entirely clear that that creates a conflict of interest, but the argument isn't unreasonable.

I agree with you up to some point but the relevant issue with the exercise of agency actions isn't at issue here, rather it's Trump's motives during the exercise of those actions. The investigation seems to be focused on Trump's "obstructionist" intent which could exist independent of Rosenstein's memo. In other words, the investigators can take Rosenstein's memo on its face while finding independent evidence (twitter, lester holt interview, etc) on Trump's intent not related to the memo.

I'm not aware if they're looking into Trump for telling everyone he's innocent. I understand that they're looking into any *actions* he took before the investigation concluded. Some of Trump's public statements indicate the motive for his actions. Whether we should have a special counsel looking into this precise issue or not is a separate issue.

Rosenstein wrote the memo that laid out the justification for Comey's firing. In order to make a case for obstruction you'd have to argue that Rosenstein's proferred reasons we pretext. That could easily make rosenstein a witness here. How do you not see that?
