At least in part because most of our criminal "laws" are cockamamie bullshit that wouldn't pass the laugh test in any civilized society.
I'm not even a shitlib but I know that 50+% of people in jail are in there over some bullshit like drugs, or "domestic violence" (otherwise known as putting your dick in crazy and then paying the price when she turns out to be a drama queen who calls the police after treating you like shit to the point where you snap; or you don't even do anything wrong and she just makes up a story because she wants a leg up in her custody battle with you).
Another large percentage of our "criminals" are people who dare to talk back to some cocky police chad and get charged with bullshit "crime" like "assault & battery on a police officer", which is just another way of saying "the police officer needed a way to avoid liability for beating the shit out of you when you got mouthy".
If you spent any time doing shitlaw criminal work, either as a prosbro or a defbro, you would know that most of our "crimes" are laughable bullshit.

Aside from the issues of protecting/weeding out the innocent and BS laws (which other poasters ITT have adequately covered), it really is a shocking economic waste that we have these ppl's FULL ATTENTION AND PRESENCE during their multi-year, expensive-as-fuck prison terms, and yet they get out being MORE likely to commit crimes than they were before they went in.
Our public schools may have problems, but at least they don't make kids dumber than they'd be if they just hung out on the streets.
