Settled a case in mediation today for $2.1 million. It's my biggest settlement to date. I had co-counsel, so I have to split attorneys fees. Client's husband was killed in a head on collision. We sued the other driver and the construction companies/city that worked on the road. Luckily with Prop 51 in California, economic damages are joint and several. The other driver barely had insurance, but even with 1% fault against the construction companies, they would be on the hook for all my client's economic damages (her husband supported her). Taking questions.

Without a lawyer, my client would have just received the 100K policy from the at fault driver. We got engineers to go inspect the road for defects, paid a significant amount of money, and came up with a theory of liability for the city/construction companies. We get paid for the value we add to the case. There is also a lot of risk on cases like this since we have to lay out significant money for an extended period of time.

what I'm curious about is how far you could've pushed this case along. City/construction defendants with deep pockets and insurance coverage in in a very plaintiff friendly state and idiot jurors who love to stick it to the man with a grieving widow. Sure it's expensive and risky to keep going but you're getting established enough to be able to bankroll these long term for a giant payday. Maybe this wasn't the case to do it but you could get some crazy large verdicts one day.

This wasn't the case to roll the dice. Basically there was a road repair before the point of impact. We argued that the repair was defective and caused the other vehicle to loose control. The problem was the defect was 1000 feet before the point of impact, and the other car was going approximately 90 miles per hour.

So a jury may have put 100% fault on the other driver and zero percent on the city. The one saving grace for us was Prop 51 (joint and several economic damages). Plus the case was not in LA, it was in a conservative jurisdiction (think victorville, bakersfield, etc). One of my friends did a wrongful death case in this jurisdiction a couple years back and only hit 1 million with clear liability. Albeit it was a 19 year old kid who had no one financially dependent on him.

I have a better case right now that will probably be tried. Truck rollover with a spinal fusion and carpal tunnel release surgery. Client couldn't work and was homeless for several months living out of his car. His wife died of cancer a few years back and this injury put him into a terrible depression. He is now 6 months post surgery and still has pain. He is barely scrapping by on his wife's pension. Policy was 1 million. I did a policy limits demand and they did not tender, so I consider it open. I'm in litigation right now, but I see this one being tried and going for a couple million. I may try and farm it out to Panish or Dordick depending on if I think they can get a lot more than me at trial.

Then there will still be product liability cases instead of negligence cases (since I'm sure driverless cars will hit each other due to errors in technology. Like is the problem that they can't market themselves to get clients? That they keep litigating like a defbro would (e.g. churning paper w/ motions that don't do anything) ? Scared of trial ?

He didn't specify and I didn't ask. All he said was that being a successful plaintiff bro required a specific personality and mentality. He rattled off a few names of mutual friends that we have as examples of those who, in his mind, would succeed. But didn't mention me and I inferred he doesn't think I'm capable.

Most defense attorneys aren't charming enough to a jury, don't have the stones to do things out of pocket. They have the same playbook being on the defense. Gotta be more creative on the plaintiffs' side.
