I just happened to come across an appeal decision involving the divorce of a biglaw partner I used to work for. He was making $2M a year at the time of the divorce. They had an estate of about $5M. His wife became a stay-at-home mom and eventually left him for her yoga instructor / boyfriend. The court extensively documented his failing health and medical problems.

He ended up getting gaped for $15K a month "maintenance," including a ton of retroactive payments. The court ruled this was not tax-deductible for him, not taxable income for her, and would not end even if she remarries. The court reasoned that she must've had a high standard of living during their marriage for the estate to only be worth $5M, so this standard of living must be maintained.

He also is on the hook for $10K a month in child support, again including a ton of retroactive payments.

Lastly, he is required to pay over $500K in legal fees that she acquired in contesting the divorce payouts. The court was not happy that he used strategies similar to what he used while representing large commercial clients in litigation, which greatly increased attorney costs.

She is now working full time after a 15-year break to raise the kids. He is apparently broke as fuck. His health is failing, he is on disability, and his legal career is done.

I also looked up the yoga instructor / boyfriend. He is jacked as fuck. The former biglaw bro desparately tried to bring in texts/emails between his wife and the yoga guy, but the court excluded all of that correspondence.

I've heard xo say guys get fucked in divorce court, but holy shit. This is devastating.

Well if that's the case he can file a motion to modify spousal and child support to reflect his new income. As long as his disability is legitimate (i.e. he didn't just retire to screw over his wife and kids' standard of living), no reasonable court would hold him to the same terms in perpetuity.

I don't know. I can't see a good reason why he needed to keep forking over $300k cash a year to her tax-free. In this case, she had resumed working and he was on disability.

I understand the basic rational for maintenance, but it seems like it should be capped at some reasonable number like the avg household income in the country (e.g., $60K a year).

As best I understand it, it comes down to whether the maintainance payments should be considered alimony, which is tax-deductable. Here, the court ruled that the payments were to continue even if one of the parties died. So, they weren't alimony, and thus he can't deduct them.

Come to think of it, I remember one time he flew 8 hours round trip in a day to attend a court hearing for work. The reason he did this was because he couldn't afford to be away from his kids for a night during his scheduled time with them. He said this would hurt his position in the divorce proceedings if he was away for a night. I remember thinking that all was really strange at the time, given that he was already in poor health. I don't think he was even 50 years old.
