Last year we only claimed like 150 square feet home office and deduction ended up being $5-6k. the thing is if you get audited you can totally furnish a 400 square foot office with a bookcase, desk computers etc. we will prob only do like 250 feet though. Our accountant says no audit risk unless your deductions outpace your 1099 income and the absolute amount of biz deduction is small. $10-15k in biz expenses isn't nuts. The 1099 income is vastly dwarfed by w2 income so he says irs knows we are already paying a lot. If you're making $500k 1099 and writing off $400k, then that's different. The thing that is really a bit ridiculous is that my husband works with his friend with a legit business who pays him $100/hr to do this shit on the side when he has time but 90% of the time, they are doing just friends stuff but they write off all their meals as working meals and they go to Tahoe and ski trips and write it off. Also funny on the carport rule, LA just got ride of their covered carport rule in 2017 so that people can build more "affordable housing" by legally converting their garages into dwellings. Our garage now has a full bath and mini kitchen. That's why we were able to do ours easily permit wise and now our property values will be higher due to rental potential. |

We have two sets of plans: One for permit purposes and one for what's happening post-inspection. It's ridiculous as what's there now is a 20-y/o cheap conversion (with full kitchen and full bath) and we're making it much nicer, but city planning dept won't let us expand the width of the doors or windows and are making us reconvert half of it to a "carport" rather than a livable space. We're also supposed to be doing away with either the kitchen or the bathroom. All sorts of issues with housing here of course, people living in RVs, etc., but then these silly rules -- just driving people to do things without getting permits. |
