why would the fact that they had security cameras matter? they have to be more vigilant because they have cameras and security? if that were the case it would just discourage companies from having security at all.

Now, if the guy was waiving around his guns in the lobby then you'd have a theory of negligence, but it doesn't sound like that was the case at all.

I don't see how they have liability.

It's a tragedy and it sucks but it wasn't MGM's fault at all.

Thankfully there have been a lot of blood donations, and monetary donations, so hopefully the victims and their families can be well taken care of.

but as i think stated above, the fact that the people were not guests of the hotel could make for some interesting wrinkles. if the shooter had decided to shoot from the street, would anybody have liability? how does it change things once he does it from the hotel? i guess you could try and make the argument that a room up on the 32nd floor provided a better vantage point and concealment.

it might also be worth noting that he checked in on sept. 28th. should the hotel be on alert days before an event in order to fulfill their duty?

What? I am a lawyer. Let's say every death results in a claim settled for $3 million, that's $180 million. Every injury averages $200k, that's $120 million. Those are pretty generous settlement values and you're still only talking $400 million. Triple them and it's only $1.2 billion. MGM is one of the largest casino and resort operators on the planet. Mandalay Bay alone is worth a billion. Oh, and by the way, this is likely covered under their CGL so insurance will be paying.

So to answer the OP's question, no they are not permafucked due to litigation. They will lose more money if tourism drops 5 percent than they will spend or lose on these cases.

Perhaps the hotel has a duty to make sure that guests aren't doing crazy dangerous shit in their rooms. like would they have any liability it he were using his room as a meth lab and it exploded?

A few broad points on the Nevada legal system in general:

1) until very recently, like two years ago, Nevada did not have a court of appeal. It was just trial courts and the Supreme Court. As a result there is very little jurisprudence on many issues. Nevada courts traditionally defer to California decisions when there's no on point Authority – if that's the case, the casinos are fucked.

2) the casinos aren't fucked. Nevada has an elected judiciary. There isn't a snowballs chance in hell that somebody gets elected to the Nevada Supreme Court without being thoroughly vetted by the casino industry.

1. What duty was breached? And to who? Do the maids owe a duty to everyone within a half-mile to search a guest's luggage when someone has like 10 bags? 2. Causation? Most of the time, intentional criminal acts are intervening causes unless the defendant was on notice that criminal activity of the same type was likely. The injuries were caused by an intervening criminal act which Defendant had no notice of.

3. Foreseeability (part of causation, but worth more) - How is the worst mass shooting in US history foreseeable?

No. Because once you take a client/case, you have the duty of zealous advocacy. Taking cases, writing demand letters, and then failing to follow up is a bad idea.

1. If you get that reputation in your community, nobody is going to take your demand letters seriously. Makes you have to work harder in the long term, because you will always have to file suit to get any serious settlement offer. This is 10x as true when you've got a case getting media coverage.

2. If you regularly dump clients after writing a demand letter, you're asking for a bar grievance.

I realize lots of shitlawlyers do that, but it's still a bad idea.

A plaintiffs lawyer who has mistakenly thought that was the case and ended up wasting a year on a lost cause.

I only take cases I wouldn't mind taking to trial (as much as possible). Getting stuck with a low/no value case is the fucking worst.

Even if the shooting isn't foreseeable, there is a foreseeable risk of general public being hit by intentionally defenestrated objects, which MGM probably attempts to mitigate with, e.g., plastic glasses at rooftop bars or windows that don't open. P argues there were other steps MGM could have taken to avoid such foreseeable risk (alarm system, security cam on outside windows, stonger windows), which would have prevented shooting or limited its duration. General duty to public from foreseeable risk of damage from intentionally cast projectiles and matter of fact whether additional protective measures are reasonable and would have prevented damages.

There is an argument they were negligent for not noticing him setting up cameras in the hallway. From that, you can tack on a duty to check out his room.

Still a weak case, but someone will bring it. And its possible to get a big judgment from a jury on those facts. Appeals court will probably toss, but its insurance money so it’ll setlle before then.,
