Disturbing the peace, if we are talking about yelling, texting, or emailing, typically needs to occur more than once for a judge to grant a DVRO, but practically you only need two examples to sink someone. If it is bad enough, just one. |

Going back a few years ago, two firms ago, I was defending one and winning.
All of the allegations were based in Mexico so I argued the judge didn't have jurisdiction to grant it. I moved for directed verdict or some shit while the wife was still on the stand.
The judge, I shit you not, turns to her and goes, "Can you think of any incidents in the U.S. where he made you fear for your life?"
The bitch then completely lied and said he threatened to kill her while she was giving birth to their baby in the hospital.
So then I recall her son from another marriage to the stand and get him to admit he never heard such a threat and that he was in the hospital during that birth.
Judge goes, "Well, maybe the son wasn't in the hospital the entire time with his mother."
I could tell you lots of bullshit stories like that.
Judge Hernandez granted a three year RO against an adult woman for throwing a baseball hat at her 70 year old father and saying, "Watch your back." Judge had to ask the father three times whether he feared his daughter and never said yes. Judge still granted the restraining order.
Another one that popped into my head about Judge Hernandez. He granted a restraining order after probing the pro per defendant and getting him to admit he pulled his wedding ring off his wife's finger. That wasn't even in her pleadings, but he was fishing for a reason to grant her RO.
I was in the audience watching that and when I heard the guy admit he pulled the ring off her finger I whispered to my client, "He's fucked." |
