Legally: 5 homeless guys kicking your dog hard; you shoot them all. Charges?

Date: January 5th, 2018 7:27 PM Author: talented hell let's say you're on a grassy park near your home in a large suburb. you see a friendly homeless guy call your dog over and he starts petting it. then like 4 scruffy teenagers walk over, the original guy gets up and they start kicking your dog in the face, ribs, your dog is howling. you run up on them pull out your 9 and double tap headshots to each of them. you call 911 and say "i just shot some guys killing my pet in the park, the address is x, i placed my firearm against the wall, and am waiting unarmed, but i need to go to a vet soon, please hurry."

Charge will be homicide but,
1) Pets are considered property, in general you can't use deadly force to defend property and you're not in your home, so castle doctrine also fails.
2) Extreme mental or emotional disturbance is best defense; some jurisdictions it is a complete defense and others it is a mitigating factor. Still, chance it would NOT apply because acting so calm right after tends to show you weren't disturbed.
3) If you're in ARE COUNTRY, some states have old laws where you could defend cattle or farm animals with lethal force, could try to make an argument to the appeals court that the law should be expanded to pets in keeping with "intent" of statute
Jury - almost certainly a mistrial, maybe an acquital
Bench trial - Judge might be bound to rule out emotional disturbance since you were apparently calm and able to think rationally during and after the incident |
