The case law on it is crazy. Once you notify your employer of your depression, you don't have to follow company policies to call in sick or whatever. You can just shoot your boss an email at 8am that says "depressed again" and not show up at work that day.

I saw a case where a company hired a PI to call bullshit on a guy who was claiming back spasms. They got pictures of him fixing his car in his garage when he said he couldn't get out of bed. Remember that shit the next time you want to call in sick.

It CAN be, in the sense that if you have paid leave but your employer won't let you use it for some reason, you can invoke FMLA and tell your employer to fuck off.

Yeah but you barely need anything there. And you're covered by disability discrimination laws and HIPAA if your employer tries to do jack shit about it. I think the most they can do is ask the doctor to verify that the letter isn't a forgery.
