"I answered them that it was not the custom of the Romans to give up anyone before the accused met the accusers face to face and had opportunity to make his defense concerning the charge laid against him." - Acts 25:16

I do not know if there is an uninterrupted practice of this Roman custom surviving through the dark ages, but English common law, in my estimation, is a pinnacle achievement of Western civilization, an accumulator of wisdom. At any rate, goodbye Western civilization, you had a good run.

Its bad but not as bad as your OP makes it sound. Defense can still cross examine just that its done before trial and then the video tape is played for the jury. this was previously done for offenses against children to spare them trauma and to control the cross examination better

still a shitty move and fuck shitlibs

This history, Scalia concluded, clearly shows that the Confrontation Clause was directed at keeping "ex parte" examinations out of the evidentiary record. Specifically, the Confrontation Clause applies to "witnesses" against the accused, meaning "those who 'bear testimony'". Relying on this and the historical record, Scalia stated, "the Framers would not have allowed admission of testimonial statements of a witness who did not appear at trial unless he was unavailable to testify, and the defendant had had a prior opportunity for cross-examination." Scalia determined that a prior opportunity for cross-examination was mandatory, and dispositive of whether or not testimonial statements of an unavailable witness are admissible.

"But Lisa Avalos, a professor of law at the University of Arkansas who has carried out comparative work on rape prosecutions between Britain and the US, said false allegations of rape make up just 2-3% of all rape allegations according to a study commissioned by the Home Office."

Lol at this dishonest piece of shit. The 2-3% false allegation rate are allegations that police classify as totally false (that is, lying to police). By that standard only a minority of rape allegations are true, considering most never result in prosecution.
