Amicus briefs exist to give the Court a citable source for claims well outside the record even though there is no check on those briefs' accuracy. At the COA level, Posner actively advocated for judges doing their own factual research.

There is a difference between visiting a crime scene to discount eye-witness testimony and going to a website to look at an ad that is at issue in the case. I don't know enough about this case to say whether the information Soto got online was improper or not. There are arguments dating back nearly a century (maybe longer) about what kind of extra-record factual info appellate courts can properly consider. The bigger issue is that both the "liberal" bloc (in Obergefell) and the "more conservative" bloc (in Citizens United and probably in Janus) sign on to Kennedy's TTT opinions because they need his vote. Apparently he's so thin-skinned that he'd vote the other way if anyone ever called him on his shit. |
