Amicus briefs exist to give the Court a citable source for claims well outside the record even though there is no check on those briefs' accuracy. At the COA level, Posner actively advocated for judges doing their own factual research.

The bigger issue is that both the "liberal" bloc (in Obergefell) and the "more conservative" bloc (in Citizens United and probably in Janus) sign on to Kennedy's TTT opinions because they need his vote. Apparently he's so thin-skinned that he'd vote the other way if anyone ever called him on his shit. |
