Update: 4 day trial wrapped on on Thursday. Tough trial, everything went well for us with the exception of our accounting expert sucked. I asked him to prepare numbers as to what he believed the parties were owed, instead his testimony was that the books being kept by the business were so bad that no one could possibly ascertain what anyone was owed. Not helpful.
My construction expert was amazing, the judge loved him. One of the opposing attorneys was this little man with an awful personality, just caustic as hell, and my expert threatened him in the Courtroom. The judge loved it, and seemed to think - now THAT is a construction expert.
It may not make a difference, we may still lose as the facts are the facts, but it was not the ass kicking that I feared it would be. We put on a pretty solid case despite my horrible client.
I spent Friday, Saturday, and Sunday fishing in the ocean. On Friday I went out as far as I've ever been in my boat, about 15 miles off shore. Caught bluefish, bonita, black sea bass, and a 4 foot hammerhead. Drank some brews on the boat with my friends, enjoying being a human being again. After putting about 120 hours into this case over the past 12 days or so, it felt great to feel the sun on my face and the salt on my skin. Everyone in my office is jealous of my tan.

I mean, the burden of proof is on plaintiff to show damages--it doesn't have to be precise but it has to be Something measurable
