everything is pretty much the same, just with different terminology. a louisiana lawyer will LOVE to start talking jibberish to get you to hire him as local counsel as your eyes glaze over about peremption this, usufruct that, blah blah blah. just get past the terminology and you're fine. it's actually easier to do lit in louisiana bc there's no stare decisis

ok but in other states those determinations bind lower courts when similar issues arise. You might quibble about whether that's the "technical purpose" of appellate courts, but that's the most important function of the court since any given appellate decision will likely impact dozens, hundreds, or even thousands of future proceedings. If each case is an island in LA, the appellate courts there serve a very different function than elsewhere.

That’s a narrow view. A huge portion of what a state scotus does is interpret the constitution and statutes and resolve splits among its lower courts and create common law. If the Louisiana scotus binds only the parties before it then that takes away a large part of what state scotuses typically do

One thing that is CRAZY about Louisiana from the PI perspective is how attys are allowed to front recovery to their clients BEFORE settlement. Its supposed to be for things like basic necessities, rent, transport to and from medical providers, but it translates to a bidding war w PI firms competing to offer nice cars, furnished apartments, etc, to clients during the pendency of the case, if only they'll sign up w one lawyer rather than another.

Ingratitude is specifically defined in La.Civ.Code art. 1560 to include only three instances: "1. If the donee has attempted to take the life of the donor; 2. If he has been guilty towards him of cruel treatment, crimes or grievous injuries; 3. If he has refused him food, when in distress."

Just do steal two $300 batches of crawfish and face 6-month sentences instead of the TEN YEARS you'd get for stealing $600 all at once.

one time a bunch of crawfish got out of the pond and started crawling through the ROW ditch and across the public road so people went out there with tongs and started to pick them up off the road and the landowner called the cops and tried to have them all arrested but since it was the public road there was nothing the cops could do for him

It's against the law to call a boxer mean names during a match:

There shall be no insulting or abusive remarks made by seconds, managers, or spectators and directed at the contestants. The officers of the club, and the secretary of the commission, shall at once eject persons who violate this or any other provision of this chapter.

Louisiana law allows "direct actions" against insurers. Following a huge mass tort, the parties negotiated into the wee hours and then the early morning hours before signing the deal.

The defendants and insurers were represented by NYC-based biglaw. The deal got signed around 4:30 am.

Only the Louisiana-based plaintiffs' lawyers noticed that the draft and final release did not cover insurers -- being drafted by NYC biglaw firms who were not used to dealing with direct action jurisdictions.

While the defense team was enjoying breakfast in the hotel restaurant before heading off to bed, the plaintiffs served a second action against the non-released insurers and got another 40% out of the case.

I don't buy that the "gullible" biglaw attorneys were unaware of direct actions against insurers. The much more likely explanation is that the plaintiffs attorneys refused to release the insurers and the insurers agreed to settle the claims against their insureds to avoid massive bad faith claims.

i understand that reaction, but it's what happened. the insurers and their own NYC counsel were part of the settlement negotiations and were at the breakfast table. the "Released Parties" language was treated as boiler plate. It listed the typical dozen or so released parties but did not include the word "insurers."

the version of SoL that's like a soft deadline can be suspended for various reasons - - suspension is like "tolling"

the version of SOL that's like a hard deadline has no tolling. it can only be "suspended" in specific circumstances through legislative action
