I am suing my previous landlord to get my deposit back. The trial is in 6 days. I was just served a subpoena for a counterclaim for the entire year's rent.

Is the counterclaim valid? Does it not have to be served at least 20 days before the trial?

It would require leave of court in Texas. Not helpful, I know.
