He essentially made a veiled threat to report me to the bar if I file a lawsuit against his client and I asked him, "Are you threatening me with disciplinary action to gain an advantage?"
I'm getting ready to pull out my favorite little trick for assholes like this. I never copy my clients on emails. Now that we are in the middle of a heated exchange, the next time he replies to me I'm going to cc my client. When he hits "reply all" I'm going to fire back, "Why are you communicating with my client? I never authorized you to do that."
Has never failed to scare the absolute shit out of OC. But yeah, I really don't like the emotions these exchanges tend to bring up. |

By Lauren Berg Law360, Los Angeles (December 16, 2019, 10:51 PM EST) -- A California federal judge laid into a Culver City attorney in court Monday and said the lawyer should be kicked out of the profession for sending opposing counsel profanity-laced, threatening emails demanding Allstate settle an insurance coverage suit.
The packed hearing in downtown Los Angeles started at 1:30 p.m. with no sign of the attorney in question, Christopher G. Hook of the Law Offices of Christopher G. Hook, so U.S. District Judge Otis D. Wright II instead turned to Hook’s clients, Alan Baker and his wife Linda B. Oliver.
Baker and Oliver indicated they didn’t know their attorney had been threatening Allstate Insurance Co.’s counsel and their families until after Allstate filed a motion for sanctions. When they found out, they fired Hook and hired Matthew B. O'Hanlon of Barnes & Thornburg LLP.
Because the couple knew nothing about their former attorney’s behavior, Judge Wright took his threat of dismissing the case without prejudice off the table and turned to the issue of sanctioning Hook for his conduct.
That’s when Hook stood up from the front row in the audience and announced his presence.
“Were you hiding?” Wright asked angrily. “Were you waiting to make a fashionable entrance?”
Hook sent dozens of profanity-laced emails that escalated to discriminatory slurs and threats of physical violence to Allstate’s witnesses, attorneys and their families in an effort to force Allstate into a multimillion-dollar settlement, according to Allstate’s ex-parte application seeking a restraining order and sanctions against Hook.
Allstate said the case is about a simple insurance dispute over what it costs to repair water damage to the Bakers' house, where the amount in dispute is about $200,000. But Hook demanded hundreds of millions of dollars for his former clients. In one email to Allstate's counsel, Hook said, "Hey fuck face today only the claim is on sale for [$]303 million."
Calling Allstate’s counsel “gay boys,” “faggots,” and “fucktards,” Hook sent other emails saying he was going to “waterboard each one of [Allstate’s] trolls that show up for depo” and would go “bat shit crazy on you mother fucking cock suckers,” according to the application.
Taking the threats further, Hook said he knew where an Allstate attorney lived and knew his wife’s name, the application states.
“As a result of Mr. Hook’s threats, Allstate’s counsel had no choice but to take the disconcerting step of warning his family members that they may be in danger,” the application says. “Mr. Hook’s actions go beyond the pale of anything that should be tolerated anywhere — let alone in a legal proceeding.”
Slamming his hands on the bench at Monday’s hearing, Judge Wright said he had never seen such behavior before and advised members of the audience to leave if they were “easily offended” by profane language.
Hook did not deny sending the emails and said it was an aggressive negotiating strategy to get Allstate to come to the settlement table, but it turned into anger when Allstate's counsel wouldn't return his phone calls.
“Obviously I failed to conduct myself in a professional manner,” Hook said. “It was a mistake.”
“You threatened people,” Judge Wright responded. “You called them every name under the sun.”
Judge Wright, a retired Marine Corps serviceman and police officer, said he was angry that Hook had not only threatened Allstate’s counsel, but also threatened their wives and families, and said if Hook had threatened his family he would have come after the attorney.
While Hook said he believes his profane emails are protected under the First Amendment, Judge Wright cut him off and said he had sworn in 100 new lawyers this month who were “so happy and so proud to be lawyers.”
“You just trashed their profession. You’re going to pay for this. You’re going to pay for this in a number of ways," the judge said. "You’re going to write a check. That’s just the first thing. You’ve been acting like a gangster. Tell you what, slick, this profession doesn’t need you.”
Judge Wright abruptly ended the hearing after telling Hook he would do what he could to remove him from the legal profession.
Baker and his wife first filed suit in Los Angeles County Superior Court in August, accusing Allstate of failing to hold up their end of a homeowners insurance agreement before it was transferred to the Central District of California in September.
The couple own a historic four-bedroom home, valued at about $3.6 million, in Los Angeles that was severely damaged by a bad plumbing line. They have a “deluxe homeowners’ insurance policy” with Allstate, according to the complaint. After the plumbing flood, the couple said Allstate paid for water damage remediation services, which included removing thousands of square feet of ruined flooring and wood, as well as a $15,000-per-month rental home for the Bakers to live in while their home is being repaired.
But ever since the Bakers found a contractor to complete the renovation and repairs on the house, the couple said Allstate has caused delays and has been “slow paying” the repair process. The couple said the insurance company is trying to pressure them into settling their claim and the resulting repairs.
The suit includes claims of breach of contract, breach of implied covenant of good faith and fair dealing, negligence, intentional infliction of emotional distress and elder financial abuse. The couple is seeking damages and permanent injunctive relief, according to the suit.
“I am pleased the court did not dismiss my former clients’ case, and that they can move forward with new counsel without distraction,” Hook told Law360 in an email following the hearing Monday.
